Are you sure the nursing home qualifies for H1B? I also think in that area it will come under the quota and that means no guarantee of getting one as file in April with a start date in Oct with no guarantee getting one as the demand is higher than the amount of visas available. My understanding of H1b is the nurse has to be highly skilled not newly qualified and have a bachelor degree or higher. We have had a few members have their Ca file extended for 12 months after they have written in before 6 months of application expiring.

Most nursing homes do not qualify for the H1-B as they do not require the BSN for entry level into the job first of all. Next, the H1-B thru them is via lottery system only, and the chances of getting one thru that are nil to none. With only 65,000 per year and the fact the facility would have to pay all of the fees associated with the sponsoring 100% or it gets denied as well.

Attorneys usually do not care as they get paid for just sending in the file, they do not care if it gets approved or not.

And next issue is if they are not unionized, do not expect work conditions to be that wonderful either. Most of them are under one of the unions, at least in some way or another.

And we have seen horror story aftre horror story about some of these wonderful facilities and do be aware that they get raided all of the time in CA.

p.s. In the future, do not post the same thing in multiple places as it makes it hard to follow since I know that I already responed to this very same post. And is not permitted per the TOS that we have in place here.

i just called the ca bon and asked them if them if i can have my file "extended" the guy sounded like he was not sure and just replied "maybe.. you could try that." he also mentioned the possibility of not getting it, not every file is being granted an extension.

i've also read a thread regarding having your nclex result "refiled". is that also possible for ca bon since they are the ones who keep the files that pearson submitted to them??

p.s. sorry for posting the same message in multiple threads. your replies are very much appreciated though.

it has to be done in writing when looking for an extension and if you do a search you will see a few did it before christmas last year with success. the other option is apply to another state through the process of licensure by examination and arrange ca to forward your results. we do recommend that you do not wait until only a short period is left in case there are any delays although when moving to a new bon there will be other requirements to follow

Nothing is ever done with a phone call to them, everything must be in writing. And you also need to be aware of the fact that the person that answers the phone is not aware of all of the things that can be done.

But again, there is no blanket granting of an extension, it is done on an individual basis and never for more than a year.

One cannot refile if they have an open file with CA BRN, you can only refile once a file is no longer open, but then it has been destroyed per their website and requirements. This is why we do not recommend going thru CA for initial licensure as you are going to need to go thru another state for licensure to maintain the NCLEX results.

Just makes no sense to throw out that money and for no reason. One can easily endorse to CA once they get thru the immigration process.

EAD is permission to work in the US when doing the AOS route but this is not available at this time and probably will not happen again for a few years.

I-94 is form and a record of departure/arrival in the US

If you are not already in the US then there is nothing to do but find a employer who will petition you and wait, retrogression is affecting lots and lots of nurses and we are also seeing less and less employers looking and employing foreign nurses due to the long wait.

SSN you will not get until in the US on a valid work permit
