i am considering writing my Nclex and doing some travel nursing in Florida (I am Canadian). I have a retired common law spouse with a pension. Can he get a green card? He is a dive master and wants to teach while we are down there. Another question.....if we buy property in Florida (may have a travel contract,may go permanent) do we have to pay foriegn land taxes...huge difference. Please help. These are very hard issues to research

You as a Canadian can go to the US with a TN, but I doubt if your common law spouse can go on your visa and work. The US is under retrogression and has been since 2006 so not able to get GC for a few years therefore your spouse will have to get their own work visa and not sure if they can go with a TN (not 100% sure on requirements although do know nurses get TN). A few UK members/UK nurses already in the US maybe able to help you regarding buying a home as I know a few of them had/have property in Florida before they moved

Also you are not writing NCLEX but applying to be a RN in the US of which NCLEX is part of that process

Im unsure of the whole process. just starting the "ball" rolling. My partner works for Toronto Fire and is retiring very soon. We are both VERY AVID scuba divers and fishing people. Have spent several months in the keys and "blown off" work to do this. It's the dream!!!!! Researching our possibilities. Have money and careers to invest. Need advice. any and all please

For TN you need licensure or letter from BON confirming you meet requirements (Florida doesn't give license without SSN) you also need a letter from employer and visa screen certificate which can be found on the CGFNS website. I think there is a thread in the Canadian forum but also check out the sticky in this forum Primer to working in the USA. Suzanne may have some other stuff to say about TN

Your significant other will not be able to have anything to do with getting a visa based on your TN Visa as he is not your legal spouse and you do not have an actual marriage license. Also be aware that the TN Visa is only a treaty visa and is not the green card. He will need to have a visa to visit the US if he is going to remain for any length of time, but he will not be able to do any type of work here.

There is also a retrogression in place at this time so there are no green cards available. But if there were, even as common law spouse, without an actual marriage that took place, he would not qualify for a spousal green card from you.
