Hi,

Good day!!:nurse:

I am nurse from India,I completed my NCLEX,IELTS and through an agency I filed my GC in EB3 category in Oct 2006.Recently I got married and now I am in US(holding H4 visa) with my Husband(H1B).Since I am in H4 I was unable to work here.My agency informed me that I cannot have break in my career and I should work. What should I do?

Is there any possibilities to continue my career(Its very clear to me that in H4 visa status I can't work)I am just looking for the possibilities to work here in US?I have completed my Master degree in Psychology. Is there any way to get visa changed? I wish to work legally in US.kindly help.:(

As a H4 you have no chance on working, the agency should be aware of this. Thins may start moving forward but coming from India your PD date is still at the moment going to take time. Not sure if you can do anything with your psychology but will find it hard to get a visa as a nurse to work/adjust status

Thank you for your prompt immediate response. My agency is informing me to find work in other countriess, orelse they are telling me to go back to india after 9 months to pursue my career, orelse when retrogression got lifted it will be hard to get employed since I will be not currently practising. Is it so?What can I do to solve this?My husband is in US,and I do not wish to leave the family for the sake of my carreer.kindly help

How long has your husband been under the H1-B visa? That visa is only for three years and can be renewed only once, for a total of 6 years in most cases.

With the large number of applicants from your country, it is looking like several years to be able to get a chance at a visa at the earliest. Even the AOS is out of the question as there are no visas available to adjust to.

And with the other degree that you have, the H1-B visa for you is only accepted once a year for the application and that will not be again until next April with a start date of 10/2009.

There is no way that you can legally work in any capacity at this time. How many years of work experience did you have in India before you came to the US?

Hi Suzanne, Thanks for your response. I am having 8 yrs of experience in India and Middle east. Can i do some volunteer program in Hospital and show those working hours as my experience in future? Will it be accepted by the employer's in US?

The hospitals in the US do not use volunteers as nurses. They are unable to do so because of the liability factor and their insurance policies. You may be able to get some volunteer work but in a non-nursing capacity.

You may also wish to contact some non-profit agencies to see if they have something that you could do for them as well.

But we do not expect any visas to open up for quite some time for you to be able to adjust your status to be able to get a paying job here.

Dear Suzanne,

Thanks for your reply.I am not able to understand the point you mentioned about non profit agencies. Some Hospitals are non profit agencies,in what way they can help.I am lost,I am not clear what I should exactly ask from them.

In addition at the worst case,if I am not practicing till retrogression lifts what will be the consequences? What is the procedure for reentry ?what can I do to keep me in stream with my career?

What are the other possibilities,so that I wont leave my family and work in some other country just to have experience and to get job on a day which is not in near future. Please guide me.

I am speaking of what you may know as NGOs. Not hospitals; they cannot use you in a volunteer capacity as an RN due to their liability issues.

American Red Cross, any medical missions, etc. You can contact the Dept of Health in your area and find out which agencies operate out that area.

Since you have a license, you may also be able to do something at your church as well.

(NGO = Non-Government Organization)

There are no visas that you can change to. Visas are allocated by the government and doesn't matter if hospital pushes it if there aren't any then nothing can be done.

You may be able to do some volunteer work for these agencies, but they cannot provide a visa for you that will permit you to work for them and receive payment.

We do not have any visas available now, and only the US government can issue a visa.

Dear suzanne,

This time I am approching you with different query.I was planning to migrate to Australia and initiated my registration with Nurses board of victoria.Recently I appeared for my IELTS and got less in speaking module 6.5 and above 7 in all other modules.I would like to know if I reappear IELTS exam and got required score in SPEAKING module alone and less in other modules, will it be accepted by considering the scores in my 2 IELTS certificates? Or else Is it mandatory to get all the required score in single attempt?

Thanks in advance.
