I was denied by the board of nursing examiners in the state of Texas (for alcohol charges) and now I have to appeal their decision I was wondering if anyone knew if their state did not make you have a federal background check, i do know that every state does a state check but which ones do not do a nationwide (federal check) I basically just wanted to start over in a different state and maybe not have to deal with so much hassle

As far as I know, everyone does a federal background check. I am in my first semester of nursing school and we had to fill out papers regarding where we live now and where we have lived in the past including counties. there is a girl in my class that was arrested last spring in a murder for hire plot that involved a professional hockey player...I guess because he pled out and she was found not guilty :eek: she can participate in the program. WHO KNOWS?! Good luck to you though.

I'm sure you do ... So, when the application form in any other state asks you about your legal background and if you've ever had a license denied or revoked in another state, are you just going to lie??

A bit terse, but true.

Virtually all states do extensive background checks. In addition some run fingerprint checks. To make things more difficult, many facilities do background checks, fingerprint checks, drug screens and credit checks.

Were you upfront with these issues on your Board application and with your nursing school? Many schools will not accept students, knowing that they may not be able to take Boards.

Once a charge/problem has gone to the BON, the info stays with your license info...and goes with it to the next state you move to. So...you are best to deal with the BNE and try to appeal the decision IMHO. Good luck.

I don't think you can just start over in another state. Pretty much all the states are requiring your SSN# and your fingerprints so they can check you out completely. Best way to deal with dings on your record is to just fess up about whatever it is when you apply and attach a detailed explanation plus good character references from reputable people in the community to support your case. From what I've heard, not all state boards will arbitrarily deny your application if stuff shows up on the background check. Some BONs consider these things on a case by case basis, and thats the reason for the appeals process. Just my opinion, but I think you should stick with it and appeal your case.

When you applied for you license were you required to send in a form that EXPLAINED the circumstances surrounding your alcohol charge? My state REQUIRES an explaination so that they can decide on the individual and not just the criminal history or arrest record. And if you were required.... were you honest and TOLD them or did they have to find out on their own? How long ago was your alcohol charge? Why did you school never tell you, you might be denied because of your previous record.
