you can consider this thread as closed since information posted here became obsolete on may 11 2005, once president george w bush signed the apropriations bill in to a law to make additional 50,000 visas available for nurses. this thread was started on dec 11 2004 when the worst news hit rn community that the pd dates have been retrogressed to jan 2002 and nurses will be the hardest hit.

now its official.

pd dates for eb3 cases from india,china, philippines retrogress to jan 2002.

this is worst news for the rn community who wish to migrate to us.

this means that, rns who are already in us will not be able to file i485 (aos) after dec 31 2004 till the priority dates become current. its not clear how long it will take.

those who have managed to file aos will have a huuuuuuuuuge waiting time for their gc apporval.

those who are outside us, will have a loooooooong wait

for someone who is in us and has either cgfns/ncelx (with or without visascreen), the only option is to get an employer to file for i140 and 485 before dec 31 2004. this will make them eligible for ead and legal status in us.

considering the rn shortage, there are chances that they may introduce a new visa category or an exception for nurses. depends on how hard the empoyers lobby the congress.

i finished my nursing degree in the philippines.. i just graduated last year (2004) I've passed the NCLEX just last week.. but i am an american citizen and im in guam right now and planning to move in california but am planning to stay here for a while.... am I affected?!? i have no clue..

My plan is to have it endorsed here for temporay permit.. i really dunno if they honor it here.. I didn't take CGFNS....

what's in store for me...

If you are an American citizen and hold a US Passport, then none of this applies to you. Only for those that are applying for permanent residency in the US are under the retrogression.

What state did you pass NCLEX for? And congratulations................

You should have no problem having oyur license endorsed to Guam, since you already have a SSN#.

Its really good to hear the information you are giving here. I am waiting for my packet3. I am from India and My case is already in the Chennai Consulate. I have got my number too. My case moved from NVC to Chennai consulate on November16, 2004. Can u tell me when would my interview will get sceduled?

If you still do not have Packet 3, you are going to be waiting for months before you will be in the US. Once things gets settled, it is still going to take months to get the backlog cleared up. No one is able to give you better information than that. You still have to get to Packet 4 and everything that goes along with that, as well.

I strongly doubt whether the retrogression will be off by the May 15 Visa Bulletin. The reason

President has to sign the bill to make it a law. This can take any number of days as per the descretion of President.

After presidential approval, the top levels of USCIS has to sit and decide how it will be applied to the real time scenario

May Visa bulletin is just 7/8 bussiness days away and, in all practical purposes, this looks not feasible.

Well, we have all right to be optimistic though...

I assume the June 15 Visa bulletin will have it CURRENT and retrgoression will be a thing of the past on July 1 onwards..

I agree with you NYrnTX. The retrogression may be lifted but May 15 is just too soon to tell. It is ok to be optimistic but then again we need to be realistic about it as well. Laws can be made and change, but reality is it cannot be done overnight. Let us just bid our time and hope for the best. I think the key there is PATIENCE. I am sure, we nurses have a lot of that in our system.
