I have just succesfully finished my BSN in nursing but I am currently not allowed to work in the US. Due to a law i can adjust my status without leaving the US. I am a graduate from a US school. Does anyone know what I should do first? I currently reside in Las Vegas. I have not yet taken the NCLEX since I'm a summer graduate. If anyone knows from experience or whom I should talk to please let me know. I have contacted two immigration lawyers here in the valley and they have not been very helpful :o.

Is OPT available to you?

OPT is Optional Practical Training international grads get to "practice" work in the US. It is usually about one year (or so per your circumstance).

Talk to your international advisor at school about it or do a search here on it.

Think you have been told about the reason you can't change status at the moment is due to retrogression and no visas to adjust at the moment. You really need to check the International forum out as plenty to read there about the current situation. If you can't work how are you keeping your status valid?

Regarding your question, based on the advices of the lawyers that I talked to, you can't adjust your status at the moment because theres no visa available yet. Maybe you can review and sit for NCLEX soon. NCLEX is one of the requirements needed by the employer to file the I-140 (employers petition).

If you have graduated and do not already have the OPT, then it is not available to you. And you cannot adjust a visa when there are no visas to adjust to. There is currently a retrogression in place and you are unable to do anything. And you only have 60 days after you have completed your last day of school to remain in the US, and that is what your visa states if you look at it. The D/S on the I-94 refers to last day of studies. The other thing is that you must have passed the NCLEX exam before you can even be offered a job legally in the first place.

Graduating from a US school does not automatically permit you to remain in the US, you are still under all of the requirements that all foreign nurses are under. That is why the attorneys in Nevada are unable to help you at this time. There is nothing that can be done, and the only way that you can legally remain in the US is if you will continiue on with your studies.

Suggest that you spend some time doing some reading on the International Forum about the current retrogression and the requirements that you have to meet before anything can even be started for you, if there were visas available in the first place.

There it is. According to Susanne, if you wish to remain in the US, you should re-enroll in school, ASAP.

You should probably take the NCLEX soon too.
