hello guys..I am asking in behalf of my cousin..she's also a nurse.. she and her fiancee ( a US citizen) are planning to have a wedding next year..Will she still need a visascreen certificate for her visa application when she goes to US?? if it is needed, is it for employment purposes??anyone please....

no since he wont be petition under employment based petition all she have to do is comply with the requirments of the state board she intend to practice.

her US citizen fiancee can petition her, that will be faster than when you apply for a job in the US. they can refer to the INS website for that.

There needs to be proof that the relationship has existed for sometime and was not entered into for the purpose of getting a fiance visa. They are watching this very closely now. More so than ever since the retrogression started.

I'm a Nurse from India with 4-5years of hospital experience.My husband is working in kansas state & he is on H1B visa . I'm staying here on H4 visa for nearly a year. After i came here,I did Nclex RN exam(from CA board of nursing), CGFNS exam, completed credential evaluation from CGFNS. I have taken IELTS exam scored overall band 6.5, but 6 in speaking module.

1.What should i do next?

2.Do i need to retake IELTS?

3.Do i need to do visa screen?

4.If the next time I get 7 in speaking & completed visa screen,what should i do next? Do i need to contact any recruiting agency? Can i do Greencard filing my myself without agency? How can i do that without agency?

5.In what visa a nurse can work in US?

6.If i file greencard, in which catagory do i need to file my I140? Employment based EB3 or EB3 with schedule A catagory? Once I filed I140, how long will it take?

You will need visa screen.

Currently you are affected by retrogression and can not adjust to a working visa, Visa bulletin is showing processing date of 2001 for India.

You do not need an agency can be done by yourself but at the moment many hospitals are delaying taking on foreign trained nurses due to retrogression.

You do not file the lawyer does and there is not schedule A for about 12 months. At the moment I140 can be filed and this does not enable you to work

As a dependent of one under the H1-B visa, you cannot work with that as you are aware of. You would need to apply for the petition as you being the one petitioned and that must be done by an employer, there is no way for you to do anything.

You will need to pass the English exams in order to get a Visa Screen Certificate, this is needed if you are applying for the green card.

But be aware that even with passing that, there are no visas available now for you to adjust your status to. There was an open window this summer where they were accepting petitions for the I-485 in July/August and that would have been perfect for you if you would have been done with everything and had an employer. Unfortunately, we do not expect this to open up for a couple of years due to the amount of petitions that were submitted. And you are unable to work without the I-485 being able to be submitted.

Even suggesting that you go for the MSN at this time would not be beneficial to you as there are already many from your country as well as China that have the Master's, so the wait for the EB-2 greencard is about the same as that for the EB-3 for those from your country.

Visas are based on your country of birth, not where you are citizen of or resident of now.
