i now have my ielts and nclex... what shall i do now to get a visa screen? i plan to go to the states as toursit on september... is there any chances i get to be hired by a hospital or nursing home... or shall i pay a lawyr... can you guys give me advise on this... thanks

There is no way you can go to the US on a tourist visa and expect to stay and work. Due to retrogression we are seeing more and more members posting that they are struggling to find employers due to the long wait. Paying a lawyer will also not make any difference as you still need a employer.

Does not matter if you find an employer, the issue is that there are no visas for you to adjust to. You are looking at the same time frame for the green card, five years plus. So more difficult to find an employer as well.

Is it wise or not wise to file your papers then ??? And, I also heard the rumours about the opening of EB3 sometimes this year ... is it true or false? And once, someone gets their work permit, how long does it take to get GC?

And if U file for work visa (EB3), is it going to jeopardize ur chances of getting F1 approval, if U decide to go for ur further studies, while waiting for ur work authorization and GC process?

Someone knowledgeable, please shed some light on this. Thank you.

EB3 reopens when the new visa year allocation commences in October. They have already indicated that they will recommence at a date of early 2006 but until the bulletin is published next month no one knows for sure. There is a bill going through which may offer some relief but there are still more nurses than visas waiting so doubt that you can just go to the US and expect to AOS. Maybe different if you have studied out there but generally F1 is regarded as a non immigrant visa. When going EB3 the visa is GC

But it is wise to file ur I140 right now right, so that it's atleast in the system, and will be processed whenever it will open again next time after OCT. 2008?

AOS=Adjust status which can not be done unless visa group is current

There is no way to adjust one's status at this time using the AOS. The US federal government is not accepting the I-485 and that is required to be able to adjust status.

There are so many that are already in the pipeline waiting for visas that already have completed files that even if the bill passes adding in the additional 20,000 visas per year, they are expected to go to those that have been waiting, not those that are going to be new to the process.

It is also much harder at this time to find an employer even willing to start the process for anyone right now since it is expected to be several years at the earliest for anyone to be able to work in the US that is just starting the process.

Please be very careful if you sign with an employer now as we are seeing agencies only too happy to sign someone; they are hoping that the nurse will cancel the contract with them and most have fees ranging from about $8,000 US to $45,000 US if one cancels.

EB-3 is a green card petition, it is not a working visa.
