Two nursing visas??..

Wondering if anyone can answer this... I have a friend I am working with who has been renewing her TN visa ( she is Canadian ) every year for the past 5 years and is in the process of obtaining her green card through the hospital. If she leaves the hospital, she will owe them for whatever fees they have put forth for the processing of the green card. The hospital has overstaffed us and there is not any overtime available.. so everyone is scrambling to get extra shifts ( any shift after 36 hours is paid in double time ). She was wondering if it is possible to get another visa for another facility while keeping her original visa for this hospital ( apparently you can't get two facilities on one TN visa ).. So the question is if one can have two nursing visas at the same time for two different hospitals? Will the immigration people at the border go for this? Nobody has been able to give her a straight answer...Thank you!!

If your friend have applied for AOS I- 485 petiton and has past 180 days, she can invoke some thing called as AC21 Portability where she can change the employer with out affecting pending I- 485 application. But its very important to make sure that I- 140 is approved before she do this. She can get an EAD and start working for new employer. This is a bit complicated matter and your friend needs a very experienced and good immigration attorney.

This is completely different and is talking specifically about the TN Visa that is a treaty visa that Canadians can get.

It has nothing to do with the pending I-485. They are completely separate issues. The nurse is not asking to leave the original petitioner, is just asking about picking up extra work hours right now.

And the I-485 had to be submitted more than 180 days ago for what you are speaking about, if they were just submitted, then it does not apply to begin with. And that was never mentioned here at all.

Final decision is up to the individual that is on at the border at that time, no matter what we state here. The immigration officer that is on duty that day has final say. But in the past, I know of many that have gotten two different TN Visas for working for two different facilities and there has never been an issue with it,
