hello everybody, My name is Sofia, and i am a transsexual RN from the Philippines, I am in California right now, i just had my sexual reassignment surgery, i also have my court order change or name and change of gender on my documents. i basically have a b-2 type of visa here, i am currently living with my fiance, we've been together for 3 years now, he is an american citizen and i am not, since i am officially a female here in the US, we're getting married, as he proposed to be exactly 4 months ago, right before my surgery. i am still worried about him petitioning me, i know he can, but my birth certificate in the Philippines is still a male, my passport is still my birthname and birth sex, cause by Philippine law i cannot change any of that information.

I don't know how to answer you question. I think you are breaking new ground. I think you question is how to work in the US legally. My state Mass has legalized gay marriage but I don't think the Federal Government has recognized it so it is complicated. Good Luck.
well first is i am not gay, i am a woman. and now that i have changed my name and my gender legally, i know i can marry just on to any state, federally, i am recognized as a woman, i know there were cases like this before and the marriage was granted. i know this is a challenge to uscis, that a transsexual (postop) now a woman and can do a marriage based petition.
Sorry, my mistake, I was trying ( and badly) to find a legal reasonfor your petition. You are right as a women you shouldn't have an issue getting married. Can't you just get a letter from your doctor ? Obviously this is way over my head. Some how you will get this sorted out, you have made it this far, getting some paper work straighten out should be easy.

I wonder how the uscis would handle a unique case of yours. I suggest you talk to a lawyer both in usa and philippines on ways to address your concerns.

I've got all the letters from my surgeon, signing that he did the operation, all the documents that i have been in fact a "F" on my forms here in the USA, such as drivers license, i am also will be notifying the california boards of registered nursing cause i did a name change already, cause i have applied with my birth name on the application, cause at that time, the only thing i had was my Philippine passport. yes, it's just a lot of paper work and things to do. i know, we have waited for my name change and my gender change so that we can marry. btw, i went to fit my wedding dress a while ago
well i have been going back and forth USA, for about a year now, and last august i was held for a while by the immigration, cause i am on a b-2 visa and been going back and forth, they are just worried that i am staying much longer here in the US than in the Philippines and they said i didn't violate anything, i told them that i am engaged and that i will be married, and they said that yes, my fiance can petition me cause i did all the paperwork already that i am legally a Female here in the USA.

This is something that really needs a specialised lawyer to deal with and not something that we can advise on here in the forums. Good luck but you may have a few hoops to jump through and what they tell you at the airports may not have an bearing on your actual case. Good luck
