I am getting ready to graduate in Dec-that means filling out my application to the Board...in 1996 when I was 21 I got a public intox...but it was appealed so it should not count against me or will it? ( now I am 30 yrs old) Has anyone got a similar story? What should I go? This is my first post to this board...Thanks

I would recommend that you tell them. They state that you are required to report all offenses, even if they are exponged!!! They can be a pain to deal with, but I would DEFINATELY recommend that you tell them NOW to avoid being hassled at graduation time. It's better to tell them the truth than for them to dig it up on a criminal background check. And if you tell them it was appealed (was it overturned??) and any steps you have taken to prevent it ever occuring again, then it will be much easier. The PI was overturned for lack of evidence...so there should be nothing on my record, but I just don't want any problems..Thanks for your response

I was never convicted....the attorney appealed and the case was dismissed before ever reaching court due to lack of evidence. I am worried because if I check yes to arrest on my application it will put my application into investigation mode...maybe for no reason.However, if I don't check yes...and the background check lists the incident (which it shouldn't) then it could cause more delay.
Its really a no win situation...

:) If the case was dismissed there should be no record of the incident. I would just keep my mouth shut and say "NO" when they ask if you have ever been arrested. If problems do appear later just say you were confused because the case was dismissed and that you got the words arrested confused with convicted. Sometimes honesty is not the best policy. Good luck

GO ahead and say no. If you check yes, you go through an eligibility review, and then you have to file a declatory order and it costs $150!!! IF they find it, and question it, they will send it to review anyway, but just try to avoid it if you can. I hope things work out well for you!

CAn you run your own background check first? As part of out application we had to turn in an Okla State Bureau of Invesitgation report. It costs $15 and took 5 min to run. That way you know what's on your report now and you can finally relax.

Before starting my LVN program our school required a background check. I asked my instructor about my DUI, but it did not appear in this $50 backgroudcheck. SHe told me not to worry about it.
Still- i decided to pay for my own state of TX background check $3, and found that my record was clean. I guess it was dismissed, and should now keep my mouth shut?
