Issuance or denial of student visa, I believe, is a case-by-case basis. Although being a Filipino citizen may have positive/negative effect, it will primarily be based on your credentials.

First, you should qualify on a college, recognized by the US government as eligible for issuing student visa documentation (not the actual visa). Certain colleges require some examinations depending on the degree level. English Exam is almost always a requirement. You will be viewed as a serious student visa-seeker if you have all these exams, and all the required documents.

Second, financial statement. studying in the US is expensive. Tuition, accommodation, transportation, food, etc. So a really huge amount of money must be on your financial support statement (whatever they call that).

Third, all other requirements such as (probably) health records, insurance, and the interviewer/consul may ask your purpose for studying a certain degree. If you are a nurse, and will take non-nursing degree, prove that you're not using your nursing degree to apply and work using a student visa (if this is even possible).

Fourth, your ties in the Philippines. F1 Student visa is a non-immigrant, non-dual intent visa. It's not like the H1B working visa that you can have the intention to eventually apply for residency. You need to provide proof that you have intentions of going back to the Philippines after you complete your degree. Although you may qualify for a 1 year OPT (sorta like a paid internship).

Best of Luck. God Bless!

You don't need student visa if you have an immigrant visa.[/quot

my problem is.. i may not be included for our immigrant visa I'm 21 y/o and as far as we know 21 and above will not be granted for an immigrant visa.:crying2: I'm hoping that they will consider me cause i was petitioned before i turned 21. do you have some info or know someone same with my case?

thanks iamnomad. I'm worried about the how will i prove or how will i convince them that it will just be a continuing education/studies:crying2: and also qualifying to the school that I'll be enrolling. with regards to financial statement, accommodation and transportation i will not be having any problem here.

In California there are issues regarding classes that normally are full are being cut. Some schools aren't even offering summer school due to the budget cuts. Right now California isn't the place to apply for school. You may want to do some research and maybe find a state where the budget cuts aren't so bad. Another thing you may want to do is to contact someone from the campus so they can give you more updated information. Good Luck

thanks NurseCubanitaRN2b i will do some research.

You can consult your petitioner for this matter. Or your lawyer (US lawyer) regarding this. Verify if you still legally included in the petition because it's hard to wait for nothing. If you are not then you can begin your F1 application. And if you are still legally included then try to know your Priority date for family based petition. Knowing the priority date will let you check and compare to the actual PD being processed at the moment.

i am actually looking for a university or college in New York. When it comes to financials and etc, there will be no problem. I am just wondering if it will be hard to get into a university or college in NY.

de g,

What you can do for now is search for a college that offers the program of your choice, then ask the office for international student regarding admissions. Then with that, you will know the specific requirement for the program and prepare for exams. Remember that the deadline for F1 Students is usually earlier.

Then you can start browsing the US Embassy Manila website for info regarding F1 visa.

God Bless!

If you have been included in the actual immigration petition, then you or your petitioner should have requested expedited processing of your case before you were about to turn 21 -- on the assumption that your priority date is in the cut-off date for your visa category. If it is (and you turned 21 just some weeks ago), I suggest that you explore with your lawyer the possibility of some humanitarian consideration from the National Visa Center. Remember: Those guys inside NVC are also human beings, not robotic entities under Darth Vader's command. :D
