starting a new job but will stay per diem at old job,can I roll over my 401k tonew jo

I have resigned from my job and will be starting a new job in 2 weeks. I told the old job that I would stay on per diem . When I went to inquire about my 401k to be rolled over to new job( or I may open an IRA not sure yet) they said I couldnt, because I am still per diem. Does this sound legit? Can this be? My management really suck and they are so deviant. I know they are going to try and screw me b/c I am leaving. The stress is just so overwhelming. Plase Help----Thank you

Yeah it's legit. I work contingent at my former employer and its the same deal. I can't roll my 403b over to my other 403b because I still work there. It's because you can still contribute to the 403b. Management has nothing to do with your 403b so I don't know why you think they are going to screw you there.

Is there any reason why you can't leave your 401K at your per diem job? You can have two 401Ks as far as I know.

I did'nt want to leave my 401k at the old job is because they have done so many shady things to other people. I don't trust them. We are a union hospital yet our union delagates hang out with management sipping coffe and talking about everyone behind their backs. I swear I feel like i'm in junior high. The union has done nothing for so many that have been fired this past year. This management is cleaning house and has gotten rid of alot of old timers. We were suppose to get increases on our longevity, which we never did. Had to strike to get our raise. Constantly short change us on our checks,charge pay etc. They constantly lie about everything. I'm not sure what I will do . Thanks for your replys:)

Ah dont stay on per diem.

Legally they cant touch your money. How vested are you? Meaning have you reached the point to where the employers match is yours? If you have not then you may well loose part of that money. Most plans vest at 5 or 6 years, at which point all the money the employer put in is yours. Some plans allow for smaller percentages sooner others you get nothing prior to that point.

They don't match anything for our 401k. I am vested for a pension after 5 yrs. I have 11 yrs with the hospital. The only reason why i said i would stay per diem is that i have a cousin that still will be working there and i did'nt want them to mess with her. Its going to be hard to find someone to take over my unit. Its basically the unit from hell. Most nurses don't last very long. If I don't roll it over, how do I get it when i retire? Which will be another 22 yrs. Will it still grow interst if i leave it there?

I was the one who got her the job yrs ago when we had a different DON. This mangement that we have now, is just plain evil. Morale is so low in the hospital. Most stay because its union and good benefits.
