Should I get an attorney after failing NCLEX x 3?

Hi, I am a graduate nurse since 2020. I went to a good nursing school and did not pass my exit and the owner refused to send my name even for LPN. When she was send student that not even in past semester. I get mad and listen to family and former classmates, I went to Carleen health institute for review and she send my name for florida board of nursing. I sit 3 times and did not pass. I did the mediation and now the board send me an email ask me for a meeting before they decide if they are going to approve my RN application or not. I am scared. I don't know what to do. Do I need a healt care attorney? Please help me, if someone already passed through that process please give me some good advice.

This is from the Florida Board of Nursing:

"After three failures of the same level of examination (RN, LPN), regardless of jurisdiction, the applicant must successfully complete a Florida Board of Nursing approved remedial training program. The program includes classroom and clinical components and proof of completion must be submitted at the time of application for the fourth attempt."

I honestly believe this isn't a legal issue. The challenge you're facing is passing the exam. Each state's Board of Nursing (BON) has specific regulations regarding the number of times you can retake the exam and the time frame within which you must test after graduation.

You don't need legal protection from the BON; address the reason you're failing the exam. A tutor, especially one offering individualized help, might be beneficial. Ask the Carleen faculty for tutor recommendations.

Also, take some time for reflection. You might even find that pursuing a career as a nurse isn't the right fit for you at this time, and it could be time to consider moving on and exploring other opportunities.

Regardless, take the BON's advice seriously as they understand your education and journey.

Why on earth would you need an attorney?  You need to pass the NCLEX.  That is on you and no one else.  Every single practicing nurse in the US has managed to pass the NCLEX.  

Complete the required remedial training program.  Figure out why you are failing the NCLEX and work on those areas.  If you can't pass the NCLEX, you can't be a nurse and no lawyer can do anything about that.

Sorry to tell you but a lawyer will not help you in this situation. Per your post:

1. You attended a good nursing school but did not pass their required exit exam.so school would not submit your name to BON for NCLEX.

2. Enrolled in Carleen Health Institute for NCLEX review "and she send my name for florida board of nursing".

3.  Carleen Health Institute was part of the FBI's "Operation  Nightingale" investigating fradulaent nursing schools.. See our thread: Schools under fire! Fake Degrees Caught!

On Febuary 10, 2023, the Florida Commission for Independent Education suspended and ordered Carleen Health Institute closure.  It was not providing 50% clinical instruction at this school, required by board of nursing, and in many cases only providing an NCLEX review course based on attendance at another school and / or accepting $$$ in exchange for a degree transcript and submission to FL BON for NCLEX.  Therefore, owners and administration involved in fraud unbeknown to some attendees.

You completed Careleen's NCLEX review but failed exam 3x. Therefore, FL BON carefully reviewing your application and may not approve despite completing a remediation course due to schools fraud uncovered --similar to your situation.   Other allnurses posters have decided to enroll in an accredited nursing program, graduate and then pass NCLEX in order to obtain RN license.  Best wishes for your future.
