Should I disclose for licensure?

Published

I am debating on whether I not I should add my disposition dicument and letter of explanation to my TN application to the BON. I have a previous dismissed petty charge when I was 15-years-old (so, six years ago). I was never convicted of a crime because of the completion from a diversion program. The TN app ask to check whether I have Plead guilty to any misdemeanors or felonies and I checked "no". Now, I'm thinking about whether I should retify that answer and submit court documents even though I said no on the application? I have no criminal record on a standard background check, but I know this is federal and that is very scary that my dismissed charges may show.

You were a minor, I doubt you'll be penalized for it. Ask an attorney (just consult fee), if you are worried. But, I would have checked 'no' too.

Were you living in Tennessee when the incident happened?

Records for the TBI are fed to the FBI database. You are 100% correct that everything is "there" but when it is reported back to the requesting agency, if it is sealed because you were a minor, it is not reportable to the requesting agency.

The only reason they take your fingerprints and run you through the FBI database is to pull up arrests/convictions people have had when they use a different name, alias, a state they didn't disclose they lived in, etc.

So if you have been passing regular background checks so far, I wouldn't worry about it.
