I certainly hope that Ms. Jarzabek wins her case against the hospital. What really amazes me is that the management of the hospital would be so much better served by instituting a zero tolerance policy for sexual harrassment across the board, instead of giving in to whatever pressure they seem to feel to "make the noise go away".
Nurses in these situations have a voice, and I hope they make them heard. I suspect Ms. Jarzabek will come out of this OK.
I had a co-worker that had to deal with a situation like this once. The employer (defendant) appealed/appealed/appealed/delayed/delayed/delayed. The incident occurred 6 years ago, no settlement yet, and she was pretty much black-balled in the field. She has since opened her own business. It is truly sad. Nurses are expendable, physicians aren't.
That is exactly what makes me sad about this situation. Just what you are describing. UPMC has a very specific sexual harrassment proceedure. Unfortunately, there are many different hospitals in this system and each has it's own culture. I did not say this before but this person used to be my boss. She was very by the book and I am sure she followed proceedure on reporting this situation to the letter. She was always a person that followed the proceedure manual to the letter. She always thought that doing things by the book would protect her when push came to shove. Sadly, these proceedures are used to pound the little guy into the dust when the institution wishes to do so. People in high places will bypass proceedures at the drop of the hat when it pleases them to do it. Personally, if I was a big wig with the big UPMC health system I would fire every one right down to the immediate supervisors that carried out the firing.I had a co-worker that had to deal with a situation like this once.
