I believe Florida Law has a statute for "Doctor Shopping" and if you have a court ordered subpoena I don't think HIPPA protects you from having your medical records seized by law enforcement.

I believe that the HIPAA Notice of Privacy Practices lists in its disclosure statement that the medical provider may provide the patient's health information in certain situations without authorization and that includes legal proceedings and criminal activities. Each patient receives this notice, is given the opportunity to review and receive a copy and signs a copy for said medical office. MMB
Believe the above is correct.
However, even if that written notice wasn't provided or if it was flawed in any way, the same result would hold (regarding a judge's order, etc.).
So HIPPA won't save Rush (and he and his attorney should know that).
Perhaps, what RL is really seeking is for the court to keep his medical records sealed from the public.

Yes, but as reported by a Judge on Fox News who said he has no doubt that people in government privy to his "private" medical records will no doubt leak to the press any salacious content found there.
And of course there will be some in the press who will report it. I guess what goes around comes around.

Ok, I am breaking my promise. I am so angry, if Rush had been a nurse, he would have had an emergency suspension of his license. All of his opinions had to be reinforced by all the medication he took. It was obvious he was not thinking straight when he did the Black quarterback number. I sure hope he didn't fly his own plane.

I am in south florida, so all the Rush L.'s court battles are on our local news. I will put my political feelings aside (did you notice he ran to a Democrat Lawyer to save him?)
Sorry, back to topic.....They are in court, the state wants his doctor's medical records, he went to court asking the judge for privacy.
