Question about a gross misdemeanor charge

I have a gross misdemeanor on my record from 2003 it is telephone call to harass. I had this expunged a few years ago and have a CNA lisince from my state. Do you suppose this will effect me getting my LPN license? I am also concerned about my clinical at the VA coming up.

not positive on if it will but i know i had to do a background check, and so forth when i applied for my bsn program. if it's expunged, i don't know if it will show up in the background check. maybe you can google that information on expunged charges showing up on background checks...

Have you already been accepted to perform clinicals at the VA after your caregiver background check? I know at my school and in my state, the VA is extremely picky when allowing students into their facility. A fellow classmate had a divorce on her record and the VA would not allow her to perform clinicals there.

It is my understanding that if your charges were expunged, it will not show up on your record.

Also, it really depends on the facility where you would like to work (or perform clinicals at) as to whether they would allow you to practice there, given the charges against you.

I would suggest you talk to the director of health services of your college, if you haven't done so already. They are able to direct you regarding these types of situations. Good luck to you.

i start ns in the fall and had a similar concern about my va rotation. the website for the va had paperwork that all students and potential employees had to fill out. below is the notation regarding the questions about past convictions. my saving grace is that my offenses were prior to turning 16, so i do not have to disclose. you will still have to disclose the issue to the nursing board when you apply for licensure, but not to the va if it has been expunged.

"for questions 9,10, and 11, your answers should include convictions resulting from a plea of nolo contendere (no contest), but omit (1) traffic

fines of $300 or less, (2) any violation of law committed before your 16th birthday, (3) any violation of law committed before your 18th birthday

if finally decided in juvenile court or under a youth offender law, (4) any conviction set aside under the federal youth corrections act or

similar state law, and (5) any conviction for which the record was expunged under federal or state law."
