Problem With Hospital-petitioner

Hello everyone!

I'm new here, joined a couple of months ago.

So far, I'm enjoying my stay alot. So many helpful people!

Anyway, I'm currently in a dilemma. Any help/clarification will be greatly appreciated. Here's my story:

I'm not sure whether I have reason to be anxious because I really am,

and it's getting in the way of my review for the nclex.

I'm an RN here in the Philippines.

I already passed CGFNS/IELTS and got a VisaScreen Certif last May. Then I went on to look for a reputable agency. Fortunately, I found one (i won't mention the name anymore) and i signed a job contract with their hospital-employer last July. All the papers needed were accomplished and sent to them thru fedex in August.

But the thing is, to this very day, the hospital-employer has still not filed a petition for me, despite the fact that I have submitted all the requirements to them. My agent arrived for a visit here in the Phils last Sept and told me there were "corporate policies" that need reformatting which will take about a month to do.

Now it's November. And it's been more than 3 months since I signed the contract. Now he tells me there are still series of meetings going on in the hospital and employee data are being submitted left and right, and other technicalities---bottomline: still no petition filed to this very day for me.

What may be the reason for this? I wouldn't want to doubt my agent and employer-petitioner too soon bec I feel they're clean that's why I signed with them in the 1st place. They have not asked anything monetarily from me since I'm done with all the exams includ VisaScreen (except the nclex) when I met them.

They will be paying for my nclex in January but...

the thing is...I really can't focus in my review, thinking why they haven't filed for my petition yet. :crying2:

If in filing, they are this "slow", what will ever happen to the next stages which will expectedly take longer?

Is filing of the petition that complicated as to take this long?

What do you actually know about the agency and the hospital? There is absolutely no reason that documents have not been submitted on your behalf. Is the agecny in Manila or the US?

In my personal opinion, I would give them a date to have things submitted by, or you want out of your contract. Simple as that. Their reasons given to you, do not meet my standards.

Suzanne, the agency has been operating since 1994--very good record.

Their main office is in MA but they have a Philippine-licensed sublet office here in manila where they carry out interviews, meetings, etc...

I went there a number of times and was impressed with the "professionalism" they displayed and their transparency, in addressing their applicants' concerns. I even talked with the other applicants who were very satisfied with the way things were being handled for them. They had a good deployment record. They also had a website and no less than the President/owner of the agency himself kept in constant touch w/ me thru emails (since he is based in MA).

Then came the job offer, from an equally big hospital-employer, which had many satellite branches all over the US, Australia and Puerto Rico...and which also had a website...and of good reputation, accdg to my relatives and friends in the US (i asked around).

But this hospital, if I must mention, just started its tie-up with my agency.

Meaning, I am among the 1st batch of nurses from my agency to be hired by them. So the interview was set...they liked me and I liked their contract.

Then after 2 months of thinking about it...I eventually signed (of course w/ the approval of my family). :smackingf

Things were really ok then.

I don't know what came up all of a sudden for the hospital to "act strangely" and become this 'slow' in filing our petition.

I keep asking my agent almost everyday if it has already been filed, what's up, what's taking it so long...etc..etc :banghead:

I feel it's not my agency's fault bec they, of all people, would like things to move fast. That way they can already get their money, right?

Besides, it's my hospital employer who will petition and not the agency.

And I wanted to communicate with the HR people in that hospital myself, but my agency tells me that they will be the one to take care of it. :selfbonk:

So there.......I'm still hanging on though. :confused:

Sounds like there are issues with the contract that the hospital has with the agency. That is usually the only time that there is a hang-up like this. Otherwise, everything should have been submitted right away.

I would request that your agency give you a time-frame with a specific date that they promise that your documents will be filed by, such as two more months at the latest, or you want out of the contract. Otherwise, you could be dragging for another year, or longer.....for no reason.

You signed with time in good faith that things would be taken care of appropriately, and it is not your problem that issues have come up with their contract or whatever. If this was in the US, no one would ever put up with it and you shouldn't have to either.

My personal feeling is that if documents are not filed within 30 days, 45 days at the most, when they have everything in their hands, then something is going on.

It is your choice what to do, but I would get out of it. Especially if this is the first contract that the agency has with this hospital, it means that there are issues with their contract and it can drag on for months, and then you could run into another delay in visa processing.

I will do as you suggested, that is, demand a time-frame from my agency.

I just hope that if I get out of the contract this early, I wouldn't be burdened with fees from the agency (which is what my family is more concerned about actually).

When I met the agency, I have accomplished the cgfns / ielts / Visa screen.

I'm just not sure if they would charge me for things that I didn't know about (technical aspects) which they might have spent in my behalf legal-wise.

Anyway, still very good advice from you-straighten things out even to the point of calling it quits with them if I had to! :stone

If they have not lived up to things being done in a timely manner, then there is absolutely nothing that you should be liable for. There is nothing that they have piad for if nothing has been filed yet. And if they knew that there were issues, then any costs should be covered by them for wasting your time.
