Little background I started probation back in August 2016 and tested positive on the PETH test for alcohol in September (about a month and a half later).

Yesterday, the AG and BRN offered to give my license back but want to extend my probation for 2 additional years.

My question is this - In total I'm looking at 5 years. How likely am I to get approved for early termination at the 2,3,4 year marks if *I don't screw up from now till then*? I can't see myself doing this for the next 5 years so please save me the trouble and don't say things like oh 5 year will go by so fast, etc.

I'm really contemplating if this is something I can do because I've been on this program for less than 6 months and have already spent over 2,000 dollars in FirstLab fees alone.

I have 20 months left on a 5 yr contract. You can do it. I can't answer your other question

No. In Texas NPs get 5 years. I'm ok with it. This saved my life. I could've died. It has gone by fast. I'd like to be done, but I'm on the downhill slide!

haha I reread your post about not saying it would go by fast! Sorry. I've just tried to embrace what is required. I did get some stipulations lifted but didn't ask to early complete. My request went before a committee and they approved what I did ask. Never hurts to ask, be prepared to support your request with documentation as to why your request should be granted. How you can insure safe practice if their decision is to grant your request. These programs are to protect the public. I hope you find peace in what you are faced with. My favorite saying: it is what it is! Just gotta do it!

Hi I am actually going through a similar situation. I violated because of a missed test (started in May 2016- viiolated Oct 2016) and got my letter from the Att. General yesterday. I hope to get a stipulated settlement but 2 more years is a lot. I do not know if you can petition to have your probation terminated early after a violation??? but if so I would recommend you get a evaluation done to rule out alcohol dependence. I am getting one done and it is costing me 1600, but I know I will need it in the future once I petition to have probation ended early. I will post what they offer me, my probation monitor told me 1 year but I am not sure. I am mailing my Defense notification back today. Hope this helps

Just curious, what state are you in?

I was under the probation that if your probation is extended (in my case 2 years) then you would have to wait that extension time till you can apply for early term (so origina 2 year mark + 2 years = 4 year mark) but talking to different attorneys and other nurses this is not true. It is still our right to apply for the early termination at the original 2 year mark but the chances are slim to none, obviously. i violated early on in my probation so im hoping if i dont have anymore slips up from now till my 2 or 3 year mark they will see that i am not a risk anymore. but youre absolutely right 2 years added is a long time and im going crazy just at the thought of it.

what kind of doctor or specialist are you seeing to get the alcohol dependence rule out?

Hi thanks for the response. I am in California. I actually went to a Doctor that specialize in addiction and a psychiatrist (San Francisco). I got the results I knew was true. I had mild substance abuse problem in the past but not now. No dependence problems or further treatment needed. I am not a risk and can work without restrictions etc. The board will still impose punishment but I believe if you get an evaluation done it will look good when time to apply for early termination.

I spoke to the Deputy attorney and is awaiting a stipulated settlement, but got a court date set for June 19 as of now. I am hoping for a full reinstatement with no extension but he said maybe one year. I will definitely keep you posted.

All we can do is hope for the best and continue to move forward. Trust me you are not the only one going through the crazy, stressful moments.
