Hello, fellow vagabonds out there. A few days ago i posted some info about the first assignment that was being offered to me. I received the actual contract today.I have not signed anything though.Some parts of the contract troubles me.Your opinion will be greatly appreciated.
Per contract:
Regular rate $22/hour
Minimum required hours: 40 hours weekly
Benefit adjustment: $17.31 per hour will be deducted for each hour under the minimum required hours.????
Facility Guaranteed hours: 80 hours bi -weekly. The facility may cancel a maximum of 36 hours per contract
before guaranteed hours will apply.
So, if i don't make the required 40 hours per week, they will deduct $ 17.31 per hour for the hours that i'm short?From my actual pay?Say, i worked 3 8hour shifts mon-wed and the Hosp calls me off Thurs and Friday.Does that mean they will deduct 276.96 ( 16hours x $17.31) from my $528 earnings? (3 8hour shifts)? What if it's the Hospital that calls me off?
Pls advice me. I wanted to check with you guys first before i call my recruiter.Thank you so much in advance.

It is a contract they are asking you to sign. If you don't like the terms then have them adjusted. What it sounds like to me is that they will pay you the 40 hours a week, and if you get called off then subtract the 17.31 for the hours you lose.
If the actual scenario is what you described, it is quite punitive and you should avoid the contract. Call your recruiter and clarify or ask for different terms. also shopping around is a good idea. All companies do not pay the same, have the same terms, even for same job different nurse. I was offered 46/hour per diem by one company and 62/hour per diem by another for the same job.

$17.31/hr for being short hours?? Thats seems really high. Maybe if they are paying your expensive housing, rental car & health insurance. Your company is not going to take a loss on those expenses & they can only bill the hospital for hours worked. At least they have guaranteed hours. Many are moving away from that. Let us know how it works out.

You can request that they reword the contract so that the penalty would only be assessed if you request extra shifts off, not if the facility low censuses you. This is what I do and if low censused I indicate that on my time sheet and have a supervisor initial it.
I do understand the clause since the agency is paying housing etc. even if they can't collect from the hospital.
