Hi I am going to start new job at LTC/SNF and I was just reading the orientation package and I came across where it says it is 3 days paid orientation but pay will be held for 30 days and if terminated for any reason during those 30 days, then you won't get that money. I'm in NYC and from what I understand you have to be paid for those days regardless what happens afterwards. My issue is holding the pay for 30 days as I never heard of this and not happy about it as I'm taking this position per diem for weekends only as I work FT during week n using my PTO to attend those 3 days of training. Anyone have feedback or know if able to do this or illegal? Any advice thank you!

I know you have to be paid for all hours worked. I don't believe they can " hold" your salary beyond that pay periods scheduled payday.

Call the local labor board. They should be able to tell you whether it's legal or not.

I have no idea if that is legal or not but I feel fairly confident it is a massive red flag! It would seem they have a very big problem with staff retention and that many new staff do the 3 paid orientation shifts and don't come back. I could be wrong but I suspect they also won't want to pay you if you resign in the first 30 days.
Best of luck, I suspect you will need it if you go ahead with this job.
