On F1 visa and file I-140???

A good friend of mine from college heard me talk about this forum and asked me if I would ask a question for him. He is here from London UK on a F1 student visa he is planning to remain a student till nursing visas open up whenever that is. He had passed NCLEX and has an RN licience in the state of PA.

He was wondering though he recently got an offer from an agency to employ him pending his visa. They propose filing his I-140 now to get his priority date as early as possible and he remains as a student till new visas open up. Should he do this will it cancel or threaten the safety of his student visa in any way? (I know what people will say about going with an agency I have told him it all but he just wants to get his prioroty date filed already so his wait is as short as possible)

What are your thoughts or advice to him on the safety of his student visa if he does this?

If he is in the US as a student, and is planning to go thru the AOS processing; then the PD date really does not matter. He needs to make sure that he has the Visa Screen Certificate in hand, and everything else completed.

We do not expect things to open for several years since there were so many petitions that were submitte this past summer and it will take years to get thru them all.

What does he know about this agency? Remember that if they are not in business when the visas open again, he will be starting over from Day One. It is one thing to get the PD date if you are going thru Consular Processing, and completely something else when going thru the AOS process. Having an earlier PD date will not make much of a difference for that, but his needs may be different by the time that he finishes school.

And if he is going for the MSN, then that will put him in another classification as far as visa.

If asking what to do now, would not do a thing. It will not benefit him at all, just make him indentured to this agency.

Ok thanks one other question what about filing now for the H visa the visa bulliten is saying June 2005 for world wide for the visa nurses need would it not be good for him to be filed for this so his wait starts in case no specific nurse visas are opened up?

The H1-B visa requires the BSN first of all, as well as a job that requires the BSN as entry for it. It is quite hard to find a facility that can sponsor someone with this visa. There is much written on it, just do a search.
