Nosey nurse

Nurses HIPAA

Published

I saw a nurse being nosey by looking in another patients file who was in another unit. Then they pick the phone up & gossip about the patients health.

We can't even look up our own--say--test results. It is against the policy of our company. Even POA's have to go through the correct channels to obtain information. Could be a conflict of interest. There may be a complete backstory to the OP never the less, unless there was a report going on, this could mean toast for not only the nurse doing the looking, but the nurse doing the receiving. Even if by "gossip" they were relieved that a shared patient was doing better. And to the pp, you need to be sure YOU report this as well. That you happend upon this and do not report it could get you in hot water as well...[/quote']

Jade- Yes, I reported this. But it made me nervous.

And Ruby, every place I have worked since enactment has made it clear that we may not even access our OWN charts without incurring violation. We must fill out releases to protect the hospital from litigation. It would likely be the same with a POA.

We can -- and do -- access our own. No ramifications. I'm told that POAs can access charts -- I have two coworkers who are POAs. One for an adult child with special needs and another for a parent. They told me they're allowed to, and I believed them. I've always accessed my own for lab results, etc. A message came down from on high telling us we were allowed to do so, but to be careful because our electronic fingerprints would be on it if we accessed someone else's chart.

We cannot access our chart or a family members chart. We have a system called Mychart that the docs can release things into for us to see, but using the hospital charting system to access your chart will get you a pink slip.
