Misdemeanor purged??? Confused.

I'm not asking for legal advice here... but has anyone ever experienced this????

I have two theft misdemeanors on my record from 2002 that I petitioned the court for to have them expunged only 3 weeks ago..........(so they are in the process) when it occurred to me....

I should contact the court and find out how I get certified documents and the police reports on these two misdemeanors, so that I will have it in my files in the future when I need to provide it to the Board of Nurses.

When BAM... she lady tells me I should also (in writing)request a letter about my purged misdemeanor from 1994... I said WHAT???????

Apparently I had a misdemeanor because I was driving without insurance when a teenager crashed into my car.... This is true... I didn't get a ticket, I didn't have to pay a fine, I didn't go to court, but I did pay the DMV $50.00 to drive to and from work for a restricted license for one year.

I swear....... I never understood I had a misdemeanor. Anyway.... when I petitioned to court to expunge my 2 misdemeanors of theft I had no idea about the third one... it didn't show up on FBI or DOJ background check.... I guess because it was purged.

Why is it purged???? Can I still petition for it to be expunged if it has been purged?? I know it is a good thing for employment, but can the BON see it?

Has anyone else had this experience. Do I just provide the letter??? Do I need a letter.

I will contact a lawyer when the time comes... but any knowledge of this from someone will help my crazy anxiety.

To be honest, I think you'll get better answers from your attorney about the purged charge than you will get from us here.

Also, keep in mind that you will still have to declare expunged or purged charges to most if not all BONs. Expungement will not help you sneak something past them. If you fail to declare it and the BON finds out on its own, you could find your license disciplined or even revoked on the grounds of fraud (i.e., you lied to them).

OK... I know I can't get legal advice... and I know I have to disclose expunge cases... my question was... what is a purged record??? I didn't request it to be purges... I can't get documents on it, because its purged... it doesn't show up on my crimianl background checks because it is purged... what does purged mean legally...?

I will get with a lawyer later..... when I'm ready, but has anyone else had a purged record and what can you tell me about it...

I never heard of a purged record...hence why I'm pointing you in the direction of your lawyer :)

Purged is a layman term. Expunged is the legal term.

That is why you cannot get documents on it...b/c once it's expunged, guess what? Not only can nobody else access it...YOU cannot access it either.

How do you know you have to disclose expunged cases? Does it SAY THAT on the application?

Jory.......... thanks for commenting on my posts.... it helps a lot. You mentioned to me that the clerk should never have mentioned the driving without insurance to me and you are right... that worries me. I'm thinking it was purged or expunged because I never got in trouble for another driving issue and maybe I met some type of agreement.

I'm sure I have to disclose everything to the BON that is why I was so curious about that" purged" driving without insurance record. I never knew I had it... I know stupidity isn't a good excuse, so maybe that clerk did me a favor.
