MediCAL Exclusion List, but NOT on OIG

I was placed on the Medical Exclusion list in Feb 2023, however, I am not on the OIG list, because my name does not appear every time I search. I did find my name on the medical exclusion list for surrendering my LVN CA License— I am now an RN— and I am due to renew my RN license in January 2024, and will openly disclose that there was a disciplinary action on my LVN license that has now been voluntarily surrendered, even after it expired.

My question stems from the attorney that I previously hired did not advise me to report within 30 days? Or within 10 days according to my new lawyer— my previous lawyer, just told me an advice me to SURRENDER and did not advocate for me as my new lawyer explained to me that this could have possibly been rectified without going this route. Please do understand that I was accused of something that was non-legal. My previous lawyer scammed me of thousands of dollars only to not advocate for me and to give me the wrong advice was to surrender my license. He didn't even try to help me get Probation of some of some sort.

fast-forward my newly hired lawyer now who is amazing, has advised me to write a letter to the board and she has sent a packet with it with everything we compiled together in hopes, the BRN understands that I was misinformed by my previous attorney and was misled otherwise I would have informed the BRN if I was advised to do so I didn't even know this.

Now my question is I'm due for my renewal in January and my RN record is extremely clean. It was only my LVN license that was affected. I do plan to disclose that "my attorney has already sent a packet regarding this disciplinary action previously" has anyone ever had this similar situation and were they able to renew their license? Issues I am going to be honest and with the help of my lawyer, she let me know that simplicity and honesty is key. 

I just don't want to have an issue with renewing my RN license that does not have any disciplinary actions. Because all of this was just on my LVN license, and it was a non-legal matter. Any advice would be appreciated.

You're quite insightful. I was reading some of your other posts and responses to posts. It's refreshing to see someone be so positive and encouraging to others. Especially when they're in their deepest and darkes hour..

All too often you see hypercritical, over judgemental nurses , who fail to understand that in addition to making mistakes (which we all do), sometimes there's also the element of bad luck. Even if you are fortunate enough to never make a mistake  (which I don't believe is possible), you could still find yourself in the right set of circumstances and wrong time and place. Or- you could just be someone whose been lucky enough to never make a mistake that's mattered. Most people are fortunate to skate through their career in that last category. The small percentage of us that have made mistakes that mattered, or have experienced the misfortune of wrong time and place, need to also have somewhere to go and not be further judged.

Hi there, I just wanted to clarify with you. You emailed DHCS and received your removal the very next day?  I sent an email in and received the auto-generated email that they had 60 days to reply. Someone has been emailing for the last couple of hours, asking me questions, such as my current address and whether I intend to petition for  my license to be reinstated, which I don't, But I just wanted to clarify with you that you received you release the next day🙂

Yes and no. I received confirmation that my request to be removed from the S and I list will be granted on 10/24/24. I had a unique reason for being on the list though. I've read reports of people taking a couple months, and one person a year. I was on the list secondary to a default revocation order for family to provide notice of defense. I had tried to update my address in the breeze system, and it never took. I never received the correspondence. I simply emailed them with copies of all the current unencumbered licenses I have. Then they granted the request the next day. It won't go through until 10/24

So update! I just received an email, they will release me from the list, and I will get my letter of confirmation on 10/24/24 and removed from the website in November. I wish all of the government agencies in CA worked liked this!!

UPDATE: I had to hire an attorney to petition my removal, she was indeed successful at it, because I was told and have heard from so many that CA may be difficult to remove. My attorney was there every step of the way including proving that I was misrepresented by my previous attorney and was swindled $7500 only for my first lawyer to not even perform a discovery.

BUT ANOTHER HURDLE CONTINUES... as I am being disciplined NOW by the BRN for the same thing and they UNALIVED my closed case. Hired the same attorney again, and we are working on it and I have faith and no doubt I will overcome this.

The issue is NOT on my RN license at all, but the BRN is wanting to revoke my license for the closed LVN case, I already am off the MEDI-CAL OIG exclusion list, now I am back to square one and pushing my way through and not giving up what I worked so hard for.

Sigh... trusting Gods process and praying for a beautiful outcome
