Generally speaking, the malpractice insurance underwriters do ask about participation in these programs and the circumstances thereto. In some circumstances, the insurer may decline to write a policy at all or may impose a surcharge. They will probably ask for a detailed written explanation and will consider that in their underwriting decision.
It is important to answer the application questions honestly; if one does not, and the insurance company subsequently finds out about it, usually after a claim is filed, coverage for the claim may well be denied on the basis that the applicant committed fraud by making a material mis-statement on the application, and the insurance company would not have issued the policy had they known the correct information.
