Two yrs ago I helped out a family member w. his drug addiction. He had relapsed to meth.
had been arrested for possession. He He communicated w. Enforcement, (BON) that he had been arrested.
The charge had been expunged by the courts because he successfully completed drug school. He was able to pass background checks because the courts had wiped the slates clean.
I took him to detox, then to rehab, He moved out w. sober guys, continued w. meetings, sponsors. Began working again (after a yr sobriety) as an LVN.
Lots of clean time behind him, over a yr. since arrest.
About a month ago he is notified he is being disciplined by BON. He sent a letter about his steps to recovery, included reference letters from friends in sobriety. I guess it wasnt enough.
Details of the charge AND the arrest are right under his name on the BON site. ACCUSATION FILED right under his name on the verification page, then details of the arrest.
This is so heartbreaking, I have seen his progress & how hard he's worked.
I'm an RN- I don't think this ever happens to us. We can prove we have rehabilitated, our enforcement will investigate. Usually they have grace. We also have diversion, which is a pain, but our license is intact. (And our arrest isnt listed under our name on the verification page.)
Does he have to walk away from nursing, or is there a way to 'fight" this?

I would get an attorney. One that specializes in dealing with the BON.
Find out if there is legal recourse.
I would not communicate anything with the BON of that nature without first seeking legal counsel.
He is a young guy, honest, believing the world is a good place, naive. He has already been waaaay to forthcoming & over zealous in communication, damage is done. Right under his name on the license verification page is ACCUSATION FILED & details of the arrest. I have no idea how he's ever going to work as a nurse this point on.
Is ACCUSATION FILED there forever? Never is removed?
I have been looking for the kind of attorney that deals with these cases, can't find one. Would like to at least get a consult. Not sure the poor guy has the $ to hire someone.

This is amazing to me, I think RN's are given diversion. I have never seen arrest records posted up on our site.

Accusation doesn't mean it necessarily happened, my guess is he has to go through the whole steps that BON sets up and "if he's found innocent" they'd take it off his license.
I could be wrong but the word accusation doesn't mean he was found guilty. 😒 good luck to him.
