Licensure with a criminal history?

Published

Hello. I graduated from nursing school with my BSN. I have a charge from 2007 of unathorized use of property and a charge from 2008 of failure to display license plates. I live in Ohio. What do I do about applying for the NCLEX and my license? Do I just get my fingerprints done and let the board of nursing see the charges and decide for themselves? Is there something I have to fill out since I have charges?

I have been thinking about seeing a lawyer to get the charges off my record. I spoke with a lawyer a while back and he said I was eligible but I'm a single mother, and it was more money than I had so I didn't do it. I have been researching it and you can even do the paperwork and file it yourself, I would just feel better having an attorney do it since I'd have no idea what I was doing! If the charges are going to keep me from getting my license or make it hard, then I will spend the money.

Thanks for any help you can offer!

It doesn't look good when no one has any advice to offer! :(

you must let them know of all charges because if u dont, it will look like you are hiding it from them and can ultimately deny you a license. Just be honest about it and hope for the best... thats all you can really do... good luck!

Hi there, my question is regarding the letters of recommendation required by the FL board of Nursing for my ARNP license. The charges are dismissed with proof from the courts online docket.

The Florida Board of Nursing requires 3 "Professional" letters of recommendation. I dont feel comfortable asking

the hospital where I work, but do have a good friends in other non-nursing/non-healthcare jobs and other nurses Ive worked with in the past I

could ask. Would it be appropriate to to use those people? Also, do they call/contact the people who wrote the

letters?

Thank you so much for replying!! Yes I definitely plan on being honest! I am just not sure how I go about it. Do I just do my fingerprinting for my application and then they contact me if they have questions about the charges or do I have to contact them from the start? The only thing I can find when I go to licensure and renewal on the ohio board of nursing page (Ohio Board of Nursing / Nurse Licensure Information) is a criminal history fact sheet (http://www.nursing.ohio.gov/PDFS/Discipline/CRIMINAL_HISTORY_FACT_SHEET-July_2013.pdf) but it doesn't say anything about what exactly to do?

I haven't applied to take my NCLEX yet because I don't know how I should do it? I saw some people on here talking about writing letters to the board, but there isn't anything about that on Ohio's BON website. There is a link "How to Submit Supplemental Information Requested by the Board Online." So, maybe after I apply and submit my fingerprints, they might ask for more information?

So, basically, I am just wondering if I just go about the process - apply to take the NCLEX, get my fingerprints done and have them send to the board, and wait for them to respond?

I am looking into having the charges expunged, so if that works out it won't be an issue. So far, I have talked to a lawyer, and he said I am eligible, and the fee seems reasonable to not have to deal with this the rest of my life and it coming up every time I apply for a job! But we'll see!

Not that I mind you asking with my question, but it might help if you start your own thread. You will get responses to your question and probably more responses than you will on this thread!

No that's not how it works at all. You have to disclose it on your application. Then each BONNis different. For Florida, I made a packet with all of the required documents: self explanation letter, all court documents, probation, letter of recommendation and rehabilitation. It was 46 pages. You have to jump in front and tell them, don't let them see it without you admitting to it all. And I agree with the original reply - don't put that you rarely drink or were pressured by friends. That will go over very badly.

I didn't mean that I didn't intend to tell the BON. What I meant was....Do I fill out the application for the NCLEX (and on it state that I have a criminal history) and then do my fingerprints - then wait for the BON to contact me.

The BON of Ohio doesn't state to send any explanation letter or court documents. It doesn't really state what to do if you are applying and have a criminal history. It has links of FAQs if you have a criminal history - but nothing about if you send anything in with the application or just wait for them to contact you and ask for it.

So - do I apply for the NCLEX (stating that I have a criminal history on the application), get my fingerprints done, and just wait for them to ask for additional information?

jgeniep24, did Florida BON contact you asking you for the required documents after you applied and stated you had a criminal history?

The application for licensure by examination will ask you ( have you ever been convicted.....) the answer to your questions are on the application for license.

Yes it does. The question is on the application itself
