Sorry I dont know the answer to your question although your state labor board will know. If someone does know the answer to your question and if it is illegal to designate on call for some states, I would like to know how hospitals staff their operating rooms 24 hours a day.

Being on call was very hard for me as when I am home, I like to be able to completely leave work behind when I am able but for some parts of hospitals and agencies such as hospice it is necessary. Hospitals and agencies should make it fair (pay and time off) which rarely seems to happen in my experiences.

Sorry, I don't know the answer to your question, but would like to expand on it. Is it legal in any state - or specifically in Indiana - to require a nurse to be on-call and available and not pay them to do so? Seems unfair to have a "weekend off", but in reality can't take my kids to the movies, can't go have a beer, can't leave town, etc because I'm on call - but yet I'm not paid $.01 to do so.

Anyone got an anwser for us?
