I -765 goes the same time with I-140? How long does it take for the I-140 to get approved?

If you are in the US, just worry about getting the EAD, usually about two months out. You will be able to work with that. It is completely separate from the I-140.

They should be filing an Adjustment of Status, that is what is going to get you the permission to work, not the I-140. The I-140 is the initial step towards the green card, but it has absolutely nothing to do with the EAD.

You mean in the same package? Yes.

CIS says it might take up to 450 days. It might take only one month ( that's how long my friend waited).

I don't know exactly.

OK. So they don'have to approve the I-140 in order to get the EAD? EAD takes the maximum of 90 days? Thanks Suzanne

Yes. One of my students got her EAD in just 4 1/2 weeks, also depends on what your attorney is doing.

The I-140 does not give you a work permit. It only gives you initial approval towards the green card. Only the Adjustment of Status will give you the EAD that you need to work. It is still not a "working visa." Just a document that will permit you to work while the other prcesses are being completed.

Applying for the AOS is a separate document that needs to be filed. Sorry that you r attorney did not take the time to explain this to you. They should have, it is their responsibility to do so.

Thank you Suzzane!
