For those of you that are studying in the US under either an F-1 visa, or any other where you do not have permission to work, and will need to apply for a green card when you finish your schooling-----this is for you.
You must meet all of the requirements for immigration that a foreign-trained nurse does, the only exception that you have is that the English requirements are waived for you. You still need to submit the application and get a Visa Screen Certificate. This is offered by CGFNS and the application is available on their website, http://www.CGFNS.org. There is only one application available, whether you did your training in the US, or overseas.
You will still need to find an employer that will petition for your green card. You will still need to undergo a physical exam at a physician's office that is approved by USCIS an have verification of all titers and vaccinations. If you do not have verifiable proof of having had chicken pox, etc., you will need to have either a titer drawn, or receive the vaccination. Immigration is very strict now with this, they will no longer go on what you are verbally telling them.
Hope that this helps...............most of you will also be able to get an OPT for one year of training while your documents are being processed, but you can only receive the OPT once, especially if this is now a second career for you, and you already used your OPT status for the other.
If you are coming to the US just for the MSN, and already have a BSN from overseas, you will be required to write the English exams. You are only exempt from them if this is your initial training as a nurse, meaning ADN or BSN only.
I think your missing the point...this positing was to let you know that what you posted was not accurate.
We all feel for them and read about their situation a while back and tried to help them earlier... this was for your information so that you understood that not all I -140's are just accepted... if it looks incomplete or there are questions, their I-140's will not be accepted, wasting time and money because they need to be refiled. A law suit is not the issue.. the time wasted and lives being disrupted and costs are.. That was a large international company... so all is not as it seems surface sometimes. We are all adults and need to check and check again. Take responsibility....

I graduated nursing school with BSN in May 2006 and studying for the Boards in New Jersey now. This is my second Bachelor's degree and I've had an OPT before. What options do I have in terms of getting a Greencard sponsorship by a hospital or a nursing home?
The director of my nursing school told me that I could get an I-20 from the university saying that I need to do an externship as part of the training and that would allow me to work for a particular facility, but the international student office says that I can only do that if I am taking a class. Technically I am still taking a class because one course is considered "incomplete" until I pass the school Exit exam. The tricky part is , once I pass the exit exam, I am no longer taking "the class" that allows me to work using I-20.
Can I simply apply for a Greencard with a hospital sponsorship when I get my RN license and start working? Do I have to wait until I get an approval from the immigration to start working? I don't think hospitals would hire me if I can't start working right away... How long do I have to wait to start working?

You cannot start working until you have the EAD in hand. But right now, you have amuch bigger problem at stake. You need to have the RN after your name to get a petition filed by an employer, and the visas are not going to be considered current by the end of next month or at the beginning of October at the very latest. After that, there will be a freeze on the submission of thre I-140 and I-485.
I suggest that you speak with an immigration attorney that specializes in nursing as soon as possible.

What's EAD? Why is my visa not going to be considered current at the end of next month? Are you talking about the 90 days window after the graduation? Technicaly I haven't graduated school yet because I have one incomplete class although I attended the graduation ceremony. I won't get my dimploma until I pass the exit exam. Doesn't the 90 days start from the day I get my diploma?
I also don't know of any immigration attorneys that specialize in nursing in New Jersey.
i m international student studing in maryland,i want to move to virginia after i complete my studies in december 2006. what should i do to get direct virginia licence? so i dont have to tranfer my licennce later. what should i have start to apply for greencard? since i have one more semester left.
