I am a new nurse practitioner working as an independent contractor. In my contract, I am receiving salary pay with my paycheck being given once a month. The Dr I work for decided to take a one week vacation last week and against my wishes, he decided to close the entire office. All other employees of the office are paid by the hour and have to clock in so they will not receive any pay from last week. I am currently trying to figure out if he is required to pay me since I am salary and did not choose to take that time off myself? Any information would be greatly appreciated before I send this invoice to him!

I am an NP and independent contractor as well. That's a tough question--the answer would be based upon the terms of your contract, but I would guess that you would still be paid despite the doctor closing the office. Are there any specifications about office closures that are stated in your contract (if not, I would guess that you would still receive your full salary)? Your contract will provide the strongest evidence and support you have to make a case that you should be paid. I wish you the best of luck!

I think, as a contract 1099 employee with no benefits, if you do not work, their fault, your fault, nobody's fault, you don't get paid. That's the unfortunate fact of 1099 work.

I am in an "at will" state so if the doc left for a month I would not get paid for the month. Depends what kind of state you are in.

So with the "office" closed are you still seeing patients? I'm a contract employee and my salary is based on productivity. So if I take a week off as long as I meet my productivity on the other 21 days it doesn't matter. Not sure what your specific situation is....
