I am prn in home care....I am paid per visit with no benefits. I think the only way you can be considered an independent contractor is if they do not take out any state or federal taxes out of your pay. You'd have to file them yourself.

One big note, if independent, you foot the entire tax bill. Your employer will not be splitting their part from what you pay.

I am currently on contract with a HHA. I pay all my own taxes quarterly and will get a 1099 to file along with my taxes.

I've done home health as an employee and as an independent contractor. It was not up to me, but rather to the agency which way we had to do business.
We were paid by the case in two of these agencies, and by the hour (awful idea) in another. Get really good advice if you end up being an independent contractor especially if it's in a city that has it's own business privilege tax, and business profits tax like Philadelphia. We ended up paying state, feds, and the two city taxes as well.
Good note to make on taxes. I pay city taxes in every city I work in and last year hubby and I worked in 6 cities.......and he in several states. Carry our own malpractice insurance etc.
