I need legal advice please, dropped from program

Okay so here is my situation. I am a nursing student in Southern New York and I failed my last clinical twice. The first time I failed was in the fall of 2010 because I came to clinical injured and I thought, STUPID ME, that I was being responsible, and if John my instructor wanted to send me home he could have. He did not send me home and I stayed in clinical all day, did horrible on my med pass and went to the doctor after. Prior to this clinical, I missed 3 weeks, because the instructor that I was with was fired because of legal issues and I was transferred to another instructor. I was afraid to miss the last day of clinical because I did not know what would happen to me, I never missed a clinical prior and I was about to graduate this month. The semester was ending and during the spring semester I signed up for the same clinical. I was told that I would be receiving help from faculty on how to do my procedures, but I was mistaken, because the faculty wanted me to learn on my own. I went to clinical and I still was not 100% on my procedures and I messed up. My instructor failed me the second time, BUT there are other students in the same clinical that made the same mistakes that I did and they passed the clinical and are able to graduate. I don't know why this instructor does not like me. I know that SAFETY is top priority, but I am not sure why the other students are not punished like I am. They told me that because I failed twice in clinical that I have to go to another program. I feel like I am being treated unfairly and I need to know if anyone out there thinks that I have legal case.....PLEASE HELP ME......I feel that the first time was medical and they should have not failed me....I need some advice please!!!!!

I don't know about a legal case, but can you appeal?? Maybe if you submit a letter from your doctor stating that you were injured and a personal letter pleading your case and explaining everything in detail?

Usually the other professors in the department are not even aware that you are being dismissed, but once you appeal the committee gets together and they vote. Yes, they follow the policies, but there are always exceptions to the rule. Something similar happened to me and the committee voted and they allowed me to retake the class for the 3rd time. You might not be allowed to graduate right now, as you still have to prove yourself, but a third chance is better than being kicked out.
