I-140 not filed yet!

Hi guys,

I passed NCLEX-RN in Feb 2004 and I have Iowa RN License. I passed IELTS Academic a few monthes ago, because my TOEFL score expired.

I got in touch with a recruitment agency in NC and signed a contract with them. I got a job offer that I like. But the agency has not filed my petition yet. They keep telling me next week, but this has been going on for months now. I don't know wheather to believe them or not.

Can you give me any advice? I know that NC is within Texas Service Centre, which has a huge backlog.

Can anyone tell me where I can read the new changes in immigration legislation effecting the foreign nurses. Are the new rules only for nurses from Filipines, India and China or it effects every nationality?

I will appriciate every reply.

The new rulings are based actually on where the nurse was born. Nurses who were born in China, India, and the Philiipines are covered under this. It esentially means that nurses from these countries will no longer be fast-tracked, they will have to wait for a visa number to be assigned.

When the nurses are born in China, India, and the Philiipines, they are no longer in the fast-track. Does it mean that they can't get the EAD in 2 to 3 months and start to work while waiting for their visa number to come up, but have to wait for their visa no. in order to apply for an EAD? Thanks. BTW, I'm a Chinese international BSN student.

My best recommendation is to speak with your immigration attorney. Each case is different, especially with students. In the past as a student, you filed for an OPT before you graduated, which gives you one year to work in the area where you trained, while your papers were being processed. This has now changed to some agree.

I would like to gain CCRN creditential from American Association of Critical Care Nurses. At the moment I study for a BSN degree through distance learning from Excelsior College, NY.

Only the Philippines, India and China are affected with this new visa rule. since you are from Eastern Europe then your country's visas number are current. If you file your I-140 now, then you can find yourself in the USA in 12 to 18 months. Good luck!

It will depend on which part of the US that you wish to work in. If you select a state covered by the Vermont office, you are looking at about one year for processing. More than two years for the west coast.

Fast-tracked means that your application gets a special designation and processed faster than many other designations.
