How much is too much?

I am a cna and work in a facility. Anyway, my some of my coworkers do not take a full 30 minute lunch break which is required by my states law. I do take my 30 minute break because it is the only break that I get throughout the day and I don't get paid for it. Personally, I think that its sad that they don't take their lunch break because we all need a little time to ourselves during the day imo. Its bad enough that I have to stay after my shift ends to chart and not get paid for it.

I always took my full 30 - I wasn't getting paid for 30 minutes anyway, so why wouldn't I take my time? They're giving it to me, not taking it would be like refusing a gift. ;)

Where I work we get written up if we don't take our 30 minute breaks. And we have to be relatively on time for them too. One CNA was taking her lunch near the end of the shift when things were less busy, and she got reprimanded.

Our 30 minutes are automatically deducted whether we take our break or not. No clocking out or anything. Nothing is being done to help either. I show up at 5:30 to cover that, my shift starts at 6:00 am.

I miss my break sometimes when I work 2nd shift. :( I hate doing it, but we're currently so short staffed that we sometimes have 16-20 residents each, so I don't have much choice.

It seems at my facility that the aides are either missing their breaks or taking a lot of extra breaks, no in-between.

We do get paid for our lunch break, but I definitely notice an increase in stress when I don't get a break to relax and clear my head.

Yea I am also sick of having to show up at least ten minutes early for my shift and not getting paid for it. Then I get to stay after work and chart if I didn't have time during my shift without pay. I figured it out that my job is getting about 2 hours a week volunteer time from me.

In a 12 hour shift we had to take two 15 minute breaks (not required / on the clock) and one 30 minute lunch (REQUIRED / off the clock). a *missed lunch* fell on the shift leader who failed to make sure you got your required break but since we were on the clock 12 hours and 30 minutes, we had to be paid 30 minutes of double time. Also we got paid double time for time spent over.. I usually had to stay 30 minutes catching up on charting but my boss never said anything or wrote me up because she knew how busy it was.... kinda ridicules lol

I'm pretty sure that's actually illegal, and could lead to lawsuits - forcing employees to work off the clock. I'd check into it if I were you...
