Hello,
Here is my situation:
I'm a french nurse living in NY for 2 years. I got my NY licence just 3 months ago (after 15 months of procedure). When I started the process I 've had a work permit with my visa E2. But I'm forced to change my visa for a H4 , which doesn't allow me to work.
So here I am. What can I do? Does anyone know if NY hospitals sponsor foreign nurses? What's usually the policy, will I have to work for this hospital for a certain amount of years, to "repay" them?
Just one more thing, I don't have a BSN. Do you think I can still find a job?

Unfortunately you are affected by retrogression and possible wait for up to 5 years for a GC. We have also seen very few people finding employers in the NY state and have to move outside NY for OPT. Due to over 200,000 applications in the small window that opened up in July 2007 for AOS I doubt that AOS will reopen any time soon as the demand for visas far exceeds amount of visas allocated. Plus we are seeing issues for hospitals suffering financially and laying staff off or not replacing staff that leave.

The only visa that would be available for you is the green card and that is under the retrogression.
The so-called working visas that are not usually available in NY require that one has the BSN behind their name, that is a basic requirement for that visa. But they are also only given out once a year as well if you would meet the requirements. Application would be next April with a start date of October, 2009 if one gets selected thru the lottery; but this will not work without the BSN for you.
Unfortunately, you are not going to be able to work here at this time.

A BSN is too expensive and a long process, again.
This is probably gonna end with a go back in France. I miss my job too much.

You were lucky to work. I would to work even if it was 2years.
How can you get your work visa? how can this visa stop after 2years? the hospital cannot sponsor you even if the retrogression is here?
Can you tell me a little bit more on your situation? what will you do ?

The member had to change to a H4 visa which does not allow working. At the moment there is no way you can adjust your status and work if you do not have a visa allowing work and doubt the window will open up again for a few years due to the high number that filed last year July 07 when the window did open briefly. Over 800,000 filed and many are still waiting to be processed.

I spoke with one private hospital in my state, i spoke with the manager and she told me that after my exam and when i will get my license she can sponsorize me and give me a work visa. Do you think she told me wrong? She told me that she knows for the retrogression but each hospital do whatever they want.
I am kind of lost because when i read all the informations here it looks like no way is possible and open for foreign nurses in USA, so why we continue ...

The hospitals do not give work visas that is the role of the government, they have no control over retrogression. At the moment there is no way you can adjust your status and get a GC. To be able to AOS visas need to be current and doubt that will happen for a few years. I doubt retrogression will actually go away as the demand is very high and the US will not have a open door policy. At the moment the US, as is a lot of other countries, going through economical issues with lots of people loosing their jobs and the government is encouraging retraining. We are also hearing of companies that are closing down. The country has to look after their own citizens first so can't really justify bringing in foreign workers when there are working being laid off and struggling to find work
Passing of the NCLEX exam alone will not get you a visa to work in the US even if they were available. You need to pass the English exams as well as have a Visa Screen Certificate.
If you do not possess a BSN, then there is not even a chance at any type of other visa. Without the BSN, the only visa is the green card and that is under retrogression.
Sorry that this manager made promise that they cannot keep and are probably not even aware of what needs to be done for immigration. And each hospital does not do what they want, they are not the ones that issue visas, only the US federal government does.
And next issue is that CA has one of the highest unemployment rates in the US, a facility is going to have to prove that they cannot find an American to take the job before they can even start any process for you. Chances of this are going to be quite small at best since everyone seems to be scampering around for more work.
All I can say is shame on this manager for offering something that she has no say in at all.
And the temporary work visas that you usually do not see available in CA require the BSN and are also for those that are considered specialists in their field. If you have been in the US and not working as an RN for two years, then you also do not have current work experience either.
