HIPAA Violation: Will if follow me when applying to different schools?

I am a new nursing student first year and am older then the rest of my classmates. I violated HIPAA with out realizing it by I guess using Names and Ages for a school assignment I have now been expelled from the nursing program. Will this follow me if I apply at another school? I am so broken hearted. I have been working so hard for this and now I am completely lost.

It is a clear violation of the rules and a violation like this could lead to a sentinel event and major lawsuit.

From the Joint Commission:

Quote

A sentinel event is a Patient Safety Event that reaches a patient and results in any of the following: Death. Permanent harm. Severe temporary harm and intervention required to sustain life.

No it isn't "poor judgment".   It is called consequences

A student is thrown into many new situations. Completing a clinical paper/report was new to this student. Why such a severe reaction from the school that will terminate a career before it has even begun? A little grace, understanding and kind guidance will be returned to humanity ten fold. I am coming from a place of being an instructor for 40 years. A student is a novice, not a seasoned RN. Their experiences are limited. That's why they have a faculty guiding them. This student did not "publish" the patient's name in the newspaper. Only the instructor saw it....This reaction is probably more indicative of a new instructor that just had a whipsaw reaction and did not realize this could be a teachable moment.

The teacher doesn't have the authority to dismiss a student. The school administration made the decision. If this was the only issue that the student had, then the punishment was too severe and she needs to find a higher quality school.

My experience has been the faculty member brings the issue to the Dean. The Dean listens to the faculty member and (in my experience) grants the action of dismissal. Now, I truly believe this faculty was inexperienced and maybe influenced the Dean. Frankly no professor is going to stay if their clinical decisions are over ruled by someone who is desk bound. But experienced faculty will look for patterns - does the same behavior happen again after counseling the student? If so, the faculty member may go to the Dean to bounce ideas and strategies to try again with the student.
