HH LPN Medicaid Regulations

So I was wondering......

I am a LPn and I was just hired at a HHAgency under the impression of "Just visit, fill out this form, and get paid" Which I believe they were actually having me do supervisory visits of the home health aides. I've been reading around the federal laws and i don't think this is ok for a LPN to do......

Any legal implications for me? or would it just be the agency failing an audit?

Also they want me to do inservice which i believe is suppose to be done by an experienced RN also.

Any Advice? I do need the extra money though.....

Contact your state Board and/or the RN Board to get an answer about the supervision question. I have seen it both ways so I can see how it would be confusing.

I know that for Medicare, home health aid sup visits must be done by RN, and I do think it is the same with Medicaid, but could differ depending on the state law. There should be in implications for you, since your agency is required to follow the law. Now, if you find it is unlawful, you might want to let them know that you can no longer do these visits. As far as an LPN providing an inservice, I can't see a reason why you couldn't. Who are you inservicing, what are topics? This could make a difference. As long as it concerns topics within your capacity as an LPN, there should be no reason why you couldn't do them. Then again, it would matter if the inservices are mandated by the state or feds, so your agency would be responsible for knowing this. Wish you well.
