Im confused right now. my I-140 is already approved last October 2007 and retrogression is still on going. I feel like i cant wait anymore to work in the US and at the same time to be with my family. Is it alright if i apply for working visa??coz i have the chance of getting in the US for 3-6 months? What are the conflicts i will face if i do this?Pls pls. help me. thanks..

What working visa are you thinking off? H1B is a lottery ie no guarantee that you will get one and not always do RN's meet the requirements (Usually requires a lot of experience in a high demand area and not many employers will use this route)

H1C expires in 2010 and no idea if it will be renewed as only 15 hospitals have this status and if retrogression is still ongoing then you may have to leave the US if there are no windows to adjust your status.

You will find many of nurses in the same boat and unable to do anything but wait or look to working in another country and have holidays in the US, I know not quiet the same but another option

if ever i will have a chance to get any kind of working visa, what will happen to my pending petition? I heard that i have to drop my immigrant petition, is this true?? thanks for your reply i appreciate it a lot.

Depends on visa, some visas will allow dual intent where others don't. I think you are going to find it hard to find an alternative visa to get to the US as not many hospitals will do H1B and there is a strict criteria and conditions to meet

Forget about the US government at this time, but the employer that you have signed with in the first place. Many of them have nothing to do with H1-B visas, or anything else, so that means that you would be signing with another company to work in the US. The first company has a cancellation clause in your contract, can almost bet on it, and then they have the right to cancel your petition since you will be working for someone else. And if you start with the second company and then things open up eventually, you are going to walk from that contract.

Just does not bode well for you with wanting to do this. Way too much money will need to be paid by you.

would never, ever tell anyone to do what you want to do, it will surely get you in trouble with someone someplace. And be very costly to you.
