CFR 42 Part 2 was updated on 8-14-2020, this made substance abuse records even more confidential than the placement of nuclear weapons. The entire purpose of the update was due to the opioid epidemic and the increase in the number of suboxone users, and in order to get suboxone you must have a substance use disorder (sud) which has replaced opioid use disorder (oud). The entire purpose of the update of the law was to protect your employment! Due to the fact your EMPLOYER pays for your HEALTHCARE. They are doing this to PROTECT YOU? Makes sense right. I would hope there is some logic behind the things SAMSHA does. It's actually criminal to violate this law. It's federal so how it goes is which ever law is the higher degree outweighs the other.  As Health care professionals we have safeguarded thousands if not millions collectively. So please explain to me, why is it as a Health care professional when we have been diagnosed with a SUD that we do NOT get the same benefit? Well as long as we comply with the recovery program that's privately paid for? Incorrect these programs are ABSOLUTELY REQUIRED TO FOLLOW THIS LAW!

The BON programs get away with it because participation into any alternative to discipline program is largely considered voluntary.One can argue weather this is true or not but that's how BONs justify thins. If I were to relapse I would not be reported unles the drug or behavior is federally illegal or a violation of local or state law.

YES BUT MY DIAGNOSIS IS NOT WHATS VOLUNTARY INFORMATION TO THE PUBLIC.  CFR 42 Part 2 Strictly forbids the use of a diagnosis to punish you in your profession for having a SUD. Which is what the BON does and now illegal. I was told no I mean HIPPA, I said no I mean CFR 42 Part 2 passed on 8-14-2020. That prevents you from sharing my diagnosis with the public from using in a court against me, for anything other than kidnapping, rape or murder. Which I'm not being accused of. Go look at Tennessee, Oregon or Kentuckys discipline list it does not list any charges. It lists there name and a number, not even sure it's there license number. They said In Michigan they follow the FOIA Request which is false they post the minutes from the meetings to the website which go to the search engines. Which then are searchable by your name. So googling my name you can find false allegations with an inaccurate diagnosis that has cost me, my career, my home, and my family.
