H1b Visa for nurses under FY 2010

World Immigration

I have applied for a work visa for the position as a dialysis nurse. I was filed last april 1 2009 and was wondering when will i get to have a visa? Anyone with a similar status of mine???:specs:

Specializes in Dialysis.
The Saipanes employer who interviewd me yesterday told me that the facility id St Jude Renal care or center. Do you happen to know that facility? Im also curious on how will be the processing? is it the same for US visa? and of course the salary? wat facility are you anyway? thanks a lot! Are you also a Filipino?[/quote

Ok! St Jude is a private Dialysis Facility in the island. Are you direct hire? I think Standard rate they offer for NCLEX RN is $16/hr with free housing.

Starting Nov 28 2009, They started to require a valid US visa to enter Saipan but for those who are currently here are under temporary permit and needs to apply for a parole visa for us to travel outside and be able to come back and work. You have to ask your recruiter regarding the visa process and what type of visa are they applying you since the hiring process has change after the Federal govt. took over the immigration.

I work in the dialysis facility of the hospital. Opo! Pinoy po ako!( Yes! I am Filipino!):)

oh its good that i heard it from a pinoy.. hehe..I dont really know how they are going to process it.. I'll just clarify it to them anyway. $16/ hr? is that fair for everyone there? will it increase?? how about the cost of living? is it expenseive?? how many machines they have? And what is the name of your unit? CHC? Is the processing of Visa on Saipan like in the US that will take months.. Do they use like H1b? h1c? or anything??

I hope you can answer my questions.. i really thank you for helping me out! Godbless!

$16/hr I can say is fair enough since it's 4 times the salary of a regular worker here. Will it increase? I do not know. I started with that salary 6 years ago. How many machines? Not more that 20? Yes CHC. Visa processing NOW I dont have any idea. Before it only took me 6 days for me to start work here from the time of recruitement from the Philippines. Check the link below. It might help you.

Hi Visamaster,

from your previous message: "H-1B visa does not require a master's degree. Although EB-2 visa may be approved at the USCIS level on the basis of the MA degree, there is less probability of approval at the consular level. Same thing with H-1B: The visa application may be approved at the USCIS level but not necessarily at the consular level." I have the following questions:

(1) is it easier to get EB-2 visa if I have a MSN?

(2) what is meant by "consular level" and "the USCIS level" ? what are their difference?

(3) can I still apply for the H-1B visa if I have MSN because there is a cap quota for those who have higher degree level?

I am confused by the EB-2 and the cap quota of H-1B visa. Thanks for your clarification and help.

Regards,

cympilly:)

Hi,

As regards your concerns:

1) Your MSN will be definitely crucial in the EB-2 application. But it must be certified to possess US equivalency (I presume that you are a Filipino). There are academic equivalency certification firms in the US.

2) Work or immigrant visa petitions may get approved at the USCIS (where the petitioner files the I-129 or I-140 forms). But, but: In addition, you also have to apply for the actual visa at the US consulate in Manila (required for H-1B applicants, but may be done at any US consulate anywhere in the world where you temporarily live if you are an immigrant-visa applicant). Now, this consular application is the frightening part: you are at the judgment of the consular officer. If he/she thinks that you or your petitioner does not possess the qualifications for H-1B visa, then your application may get denied. Or: he/she is not convinced by your proofs or evidence -- and may ask for more or may summarily deny your application.

3) Of course, you can still apply for H-1B visa if you have an MSN. You might be referring to that special allocation of 20,000 H-1B visas reserved for foreign nationals who obtained their master's degrees from US universities or colleges (not from Philippine universities).

Best wishes.

Hello roseller02. Can I ask for the website or contact info of your recruiter? I just passed the Philippine board exam, so I have zero work experience. Can H1B visa for me be even considered by your employer in Saipan? I'm prepared to take the NCLEX, and have a US tourist visa.

Thanks a lot.

If H1b visa for Saipan is the samething as the H1b visa for the US then you wont qualify for the H1b visa with zero work experience in nursing as you need several years experience in a specialized field with a minimum of a bachelors degree.

how long is several years exactly? 3years? 5 years experience required?

USCIS received the RFE response Oct 29, 2009...and it's more than 70 days already since then, still no decision on my H1B application. Anyone here experienced the same? They said in the letter that I should receive the decision within 60 days...

I called USCIS to check what's the problem. They said that they cannot disclose to me any information, only to the petitioner...

My H1b is now ok, approved last Jan. 14, 2010...I already had my interview last Feb. 5 and everything went well...USCIS website is not updated because my status there is still the same.

to tssalgad: Congratulations to you! i heard your story from this thread from the start. I read the whole 33 pages and in some point it enlightens me. I have my H1B petitioned last October 1, 2009 in the state of NY. The representative (agency) told me that it will took 4-6mos of approval. I guess the USCIS will soon ask me for RFE because i didn't have my VSC yet..gosh... i will ask for it then from the issuing body. In case, what are other documents considered for RFE? just getting ready, in case, hope not... God pls help. :crying2:
