Getting my RN with no board restrictions

I'm currently an LPN with restrictions on my license (no supervisors position no home healthcare etc) due to Medicaid fraud five years ago. I'm done with monitoring and probation currently working as a LPN. I just finished classes for my RN and applied for my license with the ohio board of nursing. I'm now discouraged because I got a email from the compliance department stating I may have restrictions on my RN license once I pass my boards also I wouldn't qualify for a multi state license. I'm just confused and sad because I feel I paid my dues my conviction was expunged due to the nature of my offense which was more of documentation errors and not money gain……… I'm just not sure if I should get an attorney or if anyone has gone through this.

That's impossible to answer, but if you do get an attorney it needs to be one familiar with how to deal with the BON.

Of course any restrictions on your current license are going to carry over. They will also carry from state to state if you move. I can't comment whether the restrictions were warranted or not, but they don't have anything to do with you "paying your dues" from a criminal standpoint. The BON is a separate entity and makes separate judgements, much of which isn't subject to law, such as moral turpitude. You will have to deal with this independently. I suspect you won't be able to do anything about this. How long are the restrictions in place? 

Permanent unless otherwise approved by the OBON. I plan to address my case individually. I know nurses with harsher convictions and they get a slap on the wrist.  A mistake I made three months out of 15 year career I get basically a life sentences. I basically flexed my time on one of my home health cases because we were short. I worked many hours for free, I threaten to quit on several occasions but the case manger and family begged to stay and I can flex my time if I worked pasted my hours. Which all this was documented which is why my conviction is now expunged. I didn't do it for financial gain. My mistake was just not  saying no and reporting the request . I emerged  myself understand the law and rule. I signed up for updates as rules changed via email. I even spoke with the LPN school I attended regarding how they teach the legal aspects of nursing which is why I'm in this mess. But thanks for the advice. I'm just tired of being treated as a criminal.

Yes, one can get away with murder but try to separate the government from their money (whether intentional or not) and they will have you by the short and curlies and they won't let go. I agree with the other posters...contact an attorney who is experienced in dealing with BON.

If your record was expunged, why is anyone able to find this on your record?

I believe, depending on the offense, most BONs can see expunged records. In OP case it was for Medicaid fraud so I would imagine they would have access to that record. I could be wrong.

I let the OBN know when I did my RN application. I'm not sure if they can still see it. My background always came back clear with no offenses. The offense was a misdemeanor for 12 months.
