I hope that they do not wrongfully fire a legal immigrant just because of a simple mistake.
Illegal immigrants are not that foolish to be caught. They have too many ways to circumvent the system. Many are using ITIN, instead of SSN. There would never be a mismatch.

illegal immigrants acquire other people's SSN and most do not use ITIN....SSN mismatches often occurs especially in big cities where illegal immigrants comprise a sizable population

Sorry, but it is not a simple mistake. And the person that is stupid enough to provide the ITIN#, and not have a visa to legally work in the US deserves to be deported.
And it is not an instant thing, they are given three months to provide proof and if cannot, then they are gone. And they cannot return to the US for ten years at the minimum.
And sorry, the illegals are now getting caught all of the time. The US government is not dumb as you may think. And the ITIN# also have a certain code that immigration is very aware of.
SSN# alone does not give anyone permission to work in the US, they must provide a valid visa, and that is where they are going to get caught. The employer must ask for that and be prepared to provide that information to immigration or the US government. I am a born and raised American, but when I start working for an employer, I need to show proof that I can work here, not just a SSN#. For you to think otherwise, that is a problem that you have. And now with the fines that employers are going to get hit with, expect there to be many crackdowns on things.
And for your information, many raids have been done by ICE at nursing homes in CA for this very reason. And there are many that have been picked up and deported and cannot return to the US for ten years. Sitting ducks when working in a nursing home if not doing it legally, easily to get picked up and out the door.
Suggest that you spend some time reading and understand what is legal and not legal, or you can find yourself being escorted out of town.
And they are being investigated now, the US is requiring complete proof of the ID that was used. There are large groups of immigration people working on this right now.
And they are focusing on areas that have had large illegal immigrant populations in the past. Areas such as NY and CA and FL are right up there. And the immigration detention centers in those areas are extremely full.
Burden of proof is on the illegal to provide documentation that they are who they say that they are, not just having a SSN#. But requiring much more documentation. And especially take note, that since that guy was arrested in NJ the other day for murdering those three kids, and was out on $150,000 bail for raping a child recently, there is going to be much investigation into this. And remember that a person who turns in someone to ICE gets about $500 finder's fee. And we are seeing that happen more and more, especially in the Filipino communities in CA at this time.
Money can be a good thing to some, and they are selling out their countrymen. So all is not as it seems at all. If someone is not here legally, then they need to be staring over their shoulder all of the time. Would not be any different if an American were in another country illegally, same thing would happen to them. And it does.
As I was saying, I am not subscribing to anything illegal. I am only stating some things I observe happening in the real jungle. Not all monkeys are afraid of the lions. While the lions rule the jungle, there are some wild animals not following the rule.
It is frustrating to see that. While I am following all the rules, I see some laughing at me, enjoying their earnings from illegal activities.
Anyway, I just wanted to show concern to those just starting out. Do not get frustrated if you see this happening once you got here in the future. The world is not ideal. It is not by the book.
I am talking about illegal immigrants like farmers, grape pickers, etc. These people do not even pay taxes because they are paid cash. Some illegal immigrants uses ITIN to buy cars, etc.
Are they not also using other people's name? How can there be a mismatch then if the name and SSN match? Hopefully, this new rule can also catch things like this.
I do not like what they are doing but they are doing it.
Just because a name and SSN# match, that does not mean that that is all that they check. How about age for one thing? What if they run the name and it belongs to someone that is 90 years old or has been deceased for more than 20 years?
That is why we do not rely on just name and SSN#, there must be other evidence to back up who they say that they are.
And yes, you can buy a car with an ITIN#, and you can even open a bank account at Bank of America with that, and at most other banks as well. The issue is having documentation that you can work here legally, that is what is important.
And even when you do get to the US and have the SSN# given to you, you will notice across it that it states that it is not proof for employment. That alone will not work, and if emloyers are stupid enough to look the other way, then they deserve the fines that they are now going to get.
The name and SSN# must match the other information that the government has on that person. And they do not just look at name and number, far from that. Much more specific.
It seems that the USCIS need this new rule because they cannot catch these illegal immigrants in the past. If they were very efficient in the past and were not being circumvented by illegals, they do not need this new rule.
We need stricter enforcement nowadays. We, legal immigrants, are affected by these illegal immigrants. In one way, some will suspect us to be illegal just because of our color, etc.
And they are catching them, and the employers are going to get fined, that is going to hurt the employers in their pocketbook, and that is what will get them started with requiring proper documentation.
ICE has raids all of the time in the Bay Area, as well as southern CA. Large numbers of people being held prior to being deported. And again with that fiasco in NJ last week, they are going to be taking a much harder stance at illegal immigrants.
And it is actually not a new rule, they are just going to be enforcing it more. And going after the employer now, in the past it was just after the illegal immigrant, but now, their bosses.
