I currently work full time for an intermittent home health company. I am curious about Per diem private duty jobs in my area too (assuming the work is sporadic, part time). It doesn't seem to me that there is any kind of conflict of interest since the two companies are not competing for the same patient base. What do you think?

As long as they aren't serving the same client base there is no conflict.
I worked home health for one agency and staffing for another, there was a potential conflict because the agency I did HH for did dabble in staffing. The solution was to sign a statement with both agencies that stated that I would NOT accept staffing assignments from the agency I did HH for.
There was a period where I worked doing staffing for 2 different agencies that only did staffing. I had to sign exclusivity agreements with most of their bigger customers. The agreements basically said I would only work for hospital A thru agency B. It's to prevent per diem folks from manipulating shifts with the higher paying agency.

Most of my colleagues and I have worked for more than one agency. There has never been a problem that I recall unless the employee made a problem by trying to interfere with the agency "changing" process. Of course, it is best to keep oneself as far away from the conflict of interest charges as possible by making it clear to all involved that you want no part of being blamed for any actions of the client.
