I have a question for suzanne4. I'm soon applying to take the NCLEX exam. Assuming that I pass, I plan to leave soon for the US and look for a sponsor either in the San Francisco area or in San Antonio, Tx. Atty. M. Gurfinkel in his citizen pinoy weekly tv program regularly mentions about the option of looking for an employer/hospital who will sponsor to be able to work and legally stay in the US. Please comment on this suzanne. Thanks always.

now to your question:

do not come to the us on a tourist visa with the idea of staying.

we are under a retrogression at this time and there is no way that you will be able to remain since we do not have any visas available. also, you need to have passed the english exams as well as have a visa screen certificate in hand to be able to file a petition if they were available.

does not matter what this attorney stated in their radio address, but the fact is that coming to the us with the intention of remaining also makes it dual intent, and that is not a good thing. it also means that you think that you can take cuts in front of the others that have been waiting here patiently, including both of my co-moderators, and it is not acceptable behavior at this time.

and to add to your quest: we have not seen one hospital doing any petitioning in the bay area for quite sometime since they do not know when you would be available to begin work. you are looking at five years plus if you do not have any petititions already somewhere along the pipeline of processing. there are many more applicants from your country than there are visas available as well.

this attorney has given you very poor information at this time. there is nothing that you can do as an rn to be able to remain in the us. please take the initiative to do things the legal way. ice is doing quite a bit of deporting at this time for people working illegally or overstaying visas.

suggest that you take the time to do some reading here, but definitely do not come here and expect to remain. this also only makes it harder for others from your country to even get a tourist visa when not all return home. this actually counts against your country in the scheme of things.

Yes, fire does come out because there are people that are dumb enough to continue to think that they can do this and they are being deported on a daily basis from the US.

ICE is not fooling around, and there are no visas currently available. And then when someone comes here and overstays their visa, it makes it harder for those from your country to ever get a visa to come to the US. Even if they have a family member over here that is dying, the US Embassy is just not routinely approving an emergency visa for them any longer because of so many doing what they were not supposed to.

And better yet, the ones that usually stay are the ones that got the tourist visa thru their parents, if they were to apply for one now, they would not receive it in most cases.

I do not like it when someone just thinks that they are better than everyone else and deserve to jump ahead in line in front of others that have been doing the correct and legal thing. But right now, does not matter what they do as there are no visas available to adjust to, so they will get deported and not be able to return to the US for a period of ten years.

And if you care to look at the Philippine Forum here you will see a few threads that have been started in the past few days about unscrupulous people from your country that have been taking advantage of others, as well as illegally importing workers for their shady dealings and now they have been arrested, will get jail time and then they are going to lose everything here and be deported back to your country shamefully. And do hope that this happens to them, they deserve it.

So if someone from your country, thinks that they can beat the system here, know that they will get caught and will do jail time and lose everything that they have attained here illegally.

Yup, Suzanne is correct. But I have another question, is it the best way to get a student visa while waiting for the EB3 sponsorship and get a master degree?

Not necessarily at all, also depends on the country of birth. For those from China and India, there are already many that hold the Master's degree and wishing the green card via the EB-2 status.

Coming to the US for the MSN degree is actually quite expensive to do as an international student, and you cannot work while you are in school for the most part. It is always better to go for the MSN when your employer is paying for at least part of it and you do not have international tuition charges/costs to have to deal with.

Any of those programs that you see advertising for you to come here and go to school for the MSN, actually bring you here on the J-1 visa which is an exchange visa, and you must leave the US for a minimum of two years when it is done. There is no way to adjust those visas.

I would go for experience in another country. The other issue that you have here with the MSN if you cannot work is how are you going to be able to get experience, as most have a work component to them.

Here's my 2c. If you want to come back into the US, either leave before your visa expires or leave when it's due. Do not over stay, in that case, when you go to the embassy again, they'll know you're the type who's likely to return.

And, you can come in and go out easily by applying each time instead of overstaying and putting yourself at risk of being refused a visa the second or third time.

More than that; if you overstay by a certain time, you'll get either a 3 or 10 year ban from re-entering the USA. Just not worth it.
