DUI to reckless driving FL and BON

Just looking for some advice. Please no judging as no one is perfect.

I came on here back in 2017 for the same case but I am in a different situation with it now.

I was arrested for a DUI in which I refused. I went to trial in 2019 for the refusal in which I was found not guilty. So one charge is handled.

My attorney has done numerous appeals to get the DUI charge dismissed because there is no evidence and basically was the police just looking to arrest someone that night. The appeals have been denied so far.

Unfortunately due to covid the courts are at a standstill and another trial for the actual DUI wouldn't be until 2021 at this point.

The state has given an offer to drop the charges to reckless and withhold adjudication with not points, no immobilization, etc,. They are saying probation for 6 months which after 3 I can get taken off of.

I've contacted the BON numerous times but most recent advised that only need to self report if I'm actually charged or take a plea.

I am trying to decide what to do but obviously do not want to lose my nursing license I have been at the same job this whole time and they do not know as the BON also told me I do not need to tell the either.

My question is will I lose my nursing license with a Reckless Driving? And what if anything will the BON have me do?

I've also been holding off going back to school until it was resolved to ensure it wouldn't affect my acceptance into a program or a future degree.

I live in Florida.

Any help or feedback would be appreciated.

Unfortunately, we cannot give you legal advice, nor tell what the BON will or won't do. Best to follow your attorney's advice, hold onto your license until they pry it from your cold dead hands. Good luck with this situation.

Twinkie- how did your situation turn out? I’m in the same boat. Once you are convicted are you suppose to self report within 30 days ?

I just officially took the offer. I'm going to send the information to the BON FedEx by 10/20 but according to what I read you have to report within  30 days in FL and then when you're all done you have to do it again. 

Obviously, you know it's a very stressful situation and hard to get any straight answers but when I did speak to someone at BON they said it's determined on a case-to-case basis. They made it sound like I would get a fine but no suspension.  

I guess I'll find out but it can take months for them to review it.

Did you get charged with reckless endangerment or reckless drinking ? I was able to get my charges dropped to reckless endangerment by motor vehicle .. I’m on unsupervised probation for a year - no interlock system. I’m in the process of reporting to TN BON but can’t get in touch with anyone to see what the exact process ... I’ve heard they put you through a drug and alcohol program .. I’m praying that’s not the case it was my first criminal offense. I’m also a NP so I think they will be Harder on me. Keep me posted on how it goes please. I will be praying for you as well :)

I officially  started  probation  last month. I sent all my information to the FL BON. Not really sure how long it takes to respond or what the outcome will be. But it did get dropped to a reckless with a withhold. I'll keep you posted. I know the situation stressful but so are our jobs and we can handle anything as nurses ☺

Hi. I was also charged w a dui, but they dropped it reckless and open intox non motor vehicle. (I did not have any alcohol opened I think they just added it to fine me).

how did your situation turn out? Did the board care? I’m in Michigan. 

Yikes, I am in same sitch. Just got charge dropped to wet reckless.  I almost hit a cat and swerved into a stop sign.  Admitted I had been drinking wine (w/other nurses! although I didn't say that out loud, oy vey!), so I was arrested. OMG.  I have not reported, I was going to contact an attny and have them write a report letter to BON for me.  Ths is my second, also.  I don't wish I had killed that cat, but darn I wasn't drunk and every1 else made it home fine. ?    Please Uber nurses, even if it is only a little bit of alcohol.
