Hello everyone

I am a nursing student from California who will be graduating in May 2016. I already applied to the BRN and will be sending them the necessary documents listed on their website for a misdemeanor DUI conviction from 2013. My question is regarding an open container ticket I got when I was 18. At the time, I was not arrested, my ticket was an infraction, and I did not even have to pay a fine. All I had to do was attend 12 AA meetings. I also did a LiveScan on myself recently that was sent to the DOJ and nothing came up on my record indicating I had an open container ticket. Is this something I need to report to the BRN even tho I was not convicted of anything, it's not on my criminal record, nor was I arrested or had to pay any penalties? I know that the BRN is looking for honesty and integrity however I dont necessarily want to make the appeal process even worse by reporting something that may not even show up. Does anyone have any experience with this or know what I should do?

I believe most questionnaires ask if you have "ever been convicted" of ........ Doesn't sound like you were.

to all nurses before graduating! go to this website immediately. Criminal Records - Request Your Own | State of California - Department of Justice - Kamala D. Harris Attorney General. Then get a print our of your background check for criminal records. I paid 40 dollars total. You can find a finger print scan store that charges only 15 buck including processing fee of 25 buck totaling 40 bucks. After you receive DOJ rap sheet and FBI. Look if you have any misdemeanors or felony convictions. If you do, get them expunged immediately. Having your conviction dismissed serves a stronger case to get your nurse license. There is a new law signed by brown that took into effect 2015 that the board cannot deny you a state license if your conviction has been expunged. Infractions is not considered a crime only misdemeanors or felony convictions. If you do apply for state license after graduation and your conviction has not yet been expunged the board will have every right to denial you the license. Make sure you contact a dui attorney in your area to get this done asap!!

Did you ever find an answer bc I have an open container as well that I paid for and am unsure if it shows up on live scan and if I need to submit additional documents..

No you dont need to disclose that information. You do not pay a fine and it did not go on your record. I had a similar situation (not open container tho), I paid my fine which was $200 and looked at the minute order and it showed that I was absolved of my crime. This was on federal property too. I just got my ATT so you should be fine.
