hello everyone!! this is my first time in here...i just want to ask you sometin...Do you know any agencies around here in New York or any other state in US that would petiton/ sponsor a License LPN?? coz a friend of mine will be taking her LPN exam next month but her status is over staying already..and she needs ur help if u know an agency that could sponsor her?? thanks alot! hope you could help her...Opp, before that she is a BSN graduate in the philippines..

Unless, she passes the NCLEX-RN exam, she will not be able to get petitioned for a green card. It is not possible with immigration without having the RN, the LPN is not accepted. The only way is if the nurse took the CGFNS exam and passed the English exams, and got a Visa Screen Certificate. Then for some reason or another were unable to pass the NCLEX-RN exam here.

But now with the new laws in place, it is impossible. Her other issue right now is that she overstayed, she cannot be petitioned until that is corrected, and right now there is a big crackdown that is starting on those that overstay. Bush has just launched extra funds for this.

Her smartest choice right now would be to leave the country, and start the process legally when she is at home. It will take several months before she has permission to even sit for the RN exam, no matter which state, and then get the Visa Screen Certificate.

By overstaying her visa and not getting an extension before it expired, she has "cooked her own goose." Using that idiom since it is Thanksgiving time.

Moved your post to the International Forum where it is more appropriate.

The other issue with any of this, is that once you attempt to submit to immigration, you are announcing that you have overstayed, and can be subjected to be ing deported for a minimum of three years, but right now, they are going with the ten years.

Again, the smartest move would be to leave the US as soon as possible, then go thru the correct channels for immigration, the way it should be done.

Visa over-extension is a major no-no right now with the US Government. Just take a look at some of the other posts here from nurses from the Philippines.
